Magistrate Levine has been un-j
able, in two blglily spiced hearings,'
to decide whether Frank should be
believed or not. So he passed the:
problem along to the grand jury at
the end of a hilarious court session
late Wednesday.
Ruilding up his cave lady case
against the fair Imogen*', Tinney;
testified, and produced witnesses to
testify, to the following moves made
by Iniogene in her quest for his af
feet ions:
She smashed in the door of his ex-*
pensive town "bachelor" apartment,
brought in her trunks, ami stuck so
determinedly that he was compelled;
to move out.
She caressed him with blows from,
her pretty pink fists.
She staked out her claim with
deep finger nail marks on his facet
and neck.
She kicked the windows out of a
taxicab Just to demonstrate her rage
because, he insisted on going home to:
his wife.
She tore the clothes right off his
back.
She kicked his shins until they!
were?and still are?black and blue.,
She started out with a knife?a;
potato knife?to doof Mrs. Tinney,
and Frank, too, if he would not lis-'
ten to her song of love.
Rut even with all of this, Tinney
says he didn't get real annoyed at
her. What got his goat was that!
Iniogene insisted on broadcasting her
affairs of the heart by staging .1
near-suicide. The suicide wasn't so1
bad. but as Tinney explained to the
convulsed magistrate, it was annoy-1
ing to have her wrap a photograph
of Frank Tinney around her suicide
note.
This led him to visit his former
apartment, now Imogene's by right
of conquest-?to protest against "the!
publicity." While waiting for her to
come in, he said, he accepted a "ter
rible" drink, "Scotch and gingerale,"'
from Imogene's maid. This rendered
him so 111 that lie had to go to bed
?in Imogene's klmona. And in bed 1
he remained until Imogene.camc Ini

And there was Tinney, attired In1
the klmona and a pair of black eai-i
rings he had added .thinking to
"hand a laugh" to Iniogene and thei
mutual friend he thought was with;
her. After the reporter had got an
eye full nnd departed, Frank said, h
sought his clothes to go home. Ruf

et. It was when he tried to get them:
out that the alleged assault on Imo
gene occurred, althoueh Tinney
maintained he did nothing but de-'
fend himself from Imogene who
wielded an ice pick, and her maid,
who wielded claw-like nails.
Exhibits In court included Tinney's
barked shin, which he bared; Imo
gene's walloping hand bag, a rug
from the scene of battle on whlcu
Imogene "nearly bled to death," but
which was stainless; Imogene's pink
fists and?oh, yes, the slim foot and
leg Imogene was alleged to have
used In kicking the taxicab apart.
There was some talk of baring this
leg to prove that Tinney also was a
shin-kicker, but the magistrate
would not hf-ar of It.
Tinney had "handed" the magis
trate so many laughs that he was
confident of being dismissed. Rut
after all. he wasn't a knockout, for

Takes Recitation Prize

L. Davis was winner among the de
claimers and Miss Ada While won
the medal for llie best recitation in
the declamation and recitation con
tests staged at Weeksville high
school TCiursday night.
Other entrants in the declamation
contest were Percy Cartwright and
Rolac Webb. Kach of the young oru
tors handled himself well and gave
evidence of thorough application and
splendid training.
Those competing with Miss White
for the recitation medal were Misses
Marie Hrickhousc. UaynelU- liaper,
Ethel Mae Stafford. Annie Marklmiii
and Lula White. The recitations
were exceptionally good and, des
pite the fact that they came after
the commencement address. held
the attention of the audience to the
last number.
The medals were presented by
Charles W. Wilson of Weeksville.
Following the recitation contest
