Court oi Wake, made at the last February Term, by which they granted a license to the tiefendanV authorizing , him to retail - spiritous liquors for one year within the limits of the City of Raleigh j which 'order we havs decided in another case iagakist the same defendant cannot be reviewed by the writ of Certiorari. If the license granted by the said Justices be for the reasons assigned by the plain tiffs "void and of no" ;,effect-,'r then the - defendant is liable to thtm for the pen alty claimed in this suit under the plain .provisions of the 5th sectiou of the Act ; 'of 1850, entitled "an Act for the govern ment of the City of Raleigh." : - The plaintiffs contend that the grant 'of the license in question was void be cause it was - made without the permis sion of the Board of Commissioners then in existence ; and the question is wheth er the persons who composed the Board prior to the 13th January 1855, and whose term of office expired on that day, or those ' who succeeded them and " - who therefore composed the Board when the grant was made over the Board of Commissioners whose permission was to be first had before the grant could be lawfully made within the meaning of the act referred to." ; . We deem the question an important 'one, affecting as it does the power of the .justices of the .County Court of Wake, the rights of the defendant and the good - and orderly , government of the City of Raleigh, and we have therefore given it our attentive consideration. The re sult of our reflections is that the Board of Commissioners whose term of office had expired before the silting of the County Court had no authority to give "the permission upon which the Justices acted, and that consequently their order grantiug a license to the delendant was void. Tlie reasons which have brought us to this conclusion we will now pro ceed to state." The Act of 1850 was passed, as ap- pears from its title, to amend the Act of 1830 ; and may, therefore, legitimately receive aid from it, whenever such aid may be necessary to ascertain its mean ing. The fourth section of the amend ing Act authorizes the Commissioners of the City "to levy and collect the tax not exceeding twenty-five dollars on every billiard table, nine or ten pin alley, victualling house or restaurant, and eve ry permission to retail spiritous liquors within the limits of the said City." The act does not prescribe in' express terms whether these taxes may be lev ied a nd collected annually, semi-annually, or bi annually. How then are the Cify authorities to know how often they have the power to assess and collect them ? The answer is to be found by referring to the 8th section of the Act "of 1830, by which the taxing power is conferred upon them in the following words : 'In order to raise a sufficient fund for repairing the streets of the City, and for effecting other useful and neces "sary purposes, the said Commissioners are hereby, authorized to lay, levy and collect annually a tax," fcc. We are then satisfied beyond a doubt that the taxes authorized by Act of 1850, are to be levied and collected annually. But when is the tax upon permissions to re tail to be paid ? As to thafthe Act of ,1803 cannot furnish any information, because the grant of a permission to retail is not of a nature to be listed like the taxable property and polls therein spe cified. This tax then may, in the ab scense of any provision to the contrary, be demanded when the permission is given And it is reasonable that it ' should be so, because the permission may be applied for and obtained at any time during the year, with a view to apply for a license from the Justices of the County Court, provided the mem bers or the Board which gave it, shall continue in office tint il the court shall -sit. Such too is the public law relative to the payment of the tax on the license which .the Sheriff receives as a part of the public revenue. (See I Rev. Stat. rh.102. sec 20, and Act of 1854, ch, 37, sec. 23, par. 14.) "And such we learn is the practical construction which has been placed ' upon the said 4th section " of the Act of 1850- Having thus ascer tained that the Commissioners of the City of Raleigh have, the power to levy fcird collect a tax upon the grant of their permission to retail jevery year, and not softener, and to demand payment when he grant is made, we are prepared to Understand the meaning of the Legisla ture in the enactment of the 5th section of the Art. The words are that it shall . not be lawful for the Justices of the County Court of Wake, to grant any . -license to retail spiritous liquors within the limits of the City of Raleigh, with out the permission of the Board of Com- missioners first had, and if any license shall be granted r without such permis sion in writing, attested by the Clerk of the Board of commissioners first filed with the Clerk of said County Court, such license shall be void and of no ef fect. .The question is, what Board 7 One, the members composing which had gone out of office when the license Is granted, . or one whose members are then jn official .existence? The Com missioners of the City of Raleigh are a political corporate body having perpetu al succession, but , that succession is to be kept up by the annual election of conpetent persons to fill the office. The Board of Commissioners is the name by which they are more particular! called when met for the transaction of official business That tod is a body having perpetual succession, but the members composing it change every year, for though the same individuals may be re elected for successive years, yet they have to qualifv by taking the prescri bed oaths before they can actj just as any other persons would have to do. Heuce we find the distinction between the "existing" and a "former Board," as will be seen by a reference to the 16th section of the Act of 1803. ; It follows ftom this, that all such taxes as are annual can be levied and collected only, during tbe official existence of any one set of members composing the Board which gives the permission. 4o retail, arid they may demand an immediate payment of the tax. The power to give the permis sion and the power to tax are thus shown to be co-eXtensive, and must therefore' be gin and terminate at the sametime Now, let us see how all this applies to the case before us. No person will deny that the members who come into office, and com pose what we will call a new Board, in the month af January in any yar, have power to give a permission to one who wishes to apply at the next succeeding County Court for a license to retail within the limits of the City, and to demand the payment of the tax for the same. If so, heir power being a limited and special pow er, as in its nature it must bp, is exhausted and gone. As to that, the Board is func tus officio, and any further attempt to exer cise the power must be a nullity. But per haps it may be said, that it docs not appear that the Board which granted the permis-sion-in the present case had ever bribre ex ercised the power, and that therefore the grant was valid. The clear and decisive answer is, that the Legislature did not con fer the same power which is necessarily limited to one year upon two sets of Com missioners to be exercised during the same year. Yet such would be the case if the action of the members who composed the Board of 1854 could be sustained. Their power to grant a permission to the defend ant for a license and to tax it, commenced with their entry into office. They did, or might have authorised him to apply for a licence at the February Term, 1854, and for their permission have made him pay a tax. Their successors must have the same power for 1855. And Unless the power of the former set be confined to their official term of existence, it must necessarily trench upon that of the latter, which the Legisla ture certainly never intended. ,But it may be argued that the defendant was for cer tain reasons satisfactory to himself, willing to take and pay for a permission from the Board of 1854, and that he might if he choose waive the objection to the payment of the double tax. The reply is, that the question is of poicer in the Board and his consent cannot confer what the Legislature has withheld. Viewing the case in every light in which it can be presented, it appears to us that the late Board of Commissioners did an act which amounted to the exercise of power which properly belonged to their succes sors and not to them, and that therefore, the act was unlawful and void. ) In favor of this construction too, an ob vious policy may be urged. It is that the license which the Court may grant must be in force for a part greater or less of the time during which the members of the Board who gave permission are in office ; and they will of course feel a deeper in terest in seeing that the retailer does not abuse his privilege. - The objections to the sufficiency of the warrant are all untenable. It sets forth every fact necessary to show that the penalty given by the act had been incurred. It states that thereby an action had accrued to the 'Commissioners of the City of Raleigh,' which is the flame in which the Act directs the penalty to be re covered. The judgment i3 affirmed. . In all cities there are a number of young men without ostensible means and without relations though it is generally 'said' that they belong to some far-away respectable family. In most parts of the Union these Jeremy Diddlers are suffered to range at large until the commission of some crime winds up their career. In Massachusetts these gentlemen are summarily disposed of, as appears from . the . following extract from the Boston Traveller: For years past could be seen, in pleasant weather, among the promenaders of Wash ington and other fashionable streets, a rath er well dressed man of medium height, with sandy whiskers, lliio face, and Panama hat, nice fitting gloves, &c , and who had the appearance- of having his share of this world's goods. Well dressed females were often seen in his company, his easy flow of language and graceful address making him rather a favorite. It was with great sur prise, therefore, that the advent of this per sonage at the bar of the police court this forenoon was witnessed by those present, still smiling blandly as he listened to the clerk, while reading a complaint which charged him with being an idle person, without home or means of support. ' Of course he indignantly " pleaded not guilty to such' a charge, and at the request of his counsel, Tollman - Wiley, Esq., the examination of the case was postponed un til the 2d of August next, bail being requir ed at 870, which at last accounts he had not procured, and -was still . in ' durance Vile. f - y--ri;:---; -." :; v It wiir be remembered that within a few days certain loafers of the west End and North end, who live by preying' upon the public, watching for an opportunity to cheat the unwary, have been brought up and sen tenced to the House or Industry a few h iurs, however, being . ranted to them to leave the city. The case to-day seems to be a step in advance. Mr. Kenney's chief fault 13, that for a number of years past he has been continually a borrower in a small way, until the list of bis victims has be come quite formidable. t He is of respectable connexions, who still live in NeV -Hampshire. He has a horror of labor, and the police allege that he has done nothing for a livelihood foi a number of years past. Among the witness es against him is the brother of a young lady to whom he has been paying some at tentions, and from whom according to her brother, he has obtained sums of money at various limes, amounting in the aggregate to from two to three hundred dollars. Oth er females, to whom he has been attentive, have, it is stated, contributed to his sup port, and there are numerous boarding house keepers, tailors, &c, &c , who have small bills, against him.
