The circumstances of the case are peciilf-
wly romantic and are thus narrated in the
True Delta:- f
miss MariaMjaanna, in tier petition.
states that she wns horn in the City of New
Orleans, in the year 181$. and has resided
hare ever since with a free colored woman
uq nursed her, and whose namo is Mar
tha Don Andre, ttndef the impression for
the most part of the time, that , until she
had attained her majority, that she was of
colored extraction, and daughter of Martha
Uen Andre. On becoming of age, how
ever, her nursrj nd gurdian oM -her that
the. was born of white parents, who for rea
ons best known to themselves had kept
her birth, a secret from her. On this infor
mation. Mart a took her position m.socieiy
as a white woman, Although these cir
cumstances were explained to the general
satisfaction of the parties whom she was
in the habit of visiting, nevertheless, there
were persons malicious enough to insist
that she was nothing more or less than a
colored person, and among the rest one
Matbieu Richeto, on various occaions, de
nominated her publicly as such, thereby
depriving her of ber right to the social po
sition to which she was entitled amongst
white persons. For this deprivation of her
tight, damages are claimed. '
In proof of this statement the deposition
of Man ha Don Andra, her former nurse, is
before the court. She is now 75 years of
age, and resides ut the cornet of Bourbon
and Orleans streets. I She says that some
time in the rear 1818 a certain Madame
Picole came to her residence, bringing with
her a newborn infant, and requested her
to take chargs of it at monthly wajjes, to
be paid her. 1 The lady expressed' a wish
that the child should be secretly raised, as
its mother was a young lady of one of the
first families in the City, who . would not,
for .the world s wealth, have her name
-mentioned or her reputation utiltied. Short
ly ufterwards the mother of the child, de
scribed by Mart a as a beautiful young fe
male, about twenty years of age, called
and imposed on her a' solemn injunction
that she never would reveal anything of
the matter, and at the same time told her
the real name of the child, her lineage, &c ,
etc., requesting br to have the child bap-
tized as' a white child, by the name which
she now bears. The request was complied
witn, and tne baptismal record ot tne Ca
thedral of St. Louis proves the fact. ' Up to
her majority Suzannu was under the tm-
ptession that she was the duughter of Mar
tha, as it was the wish of her own mother
such should be the case. Proof fin sub
stantiation of these circumstances) of the
death of Martha's own child, shortly after
the reception of the little nurslinc, was also
produced, and on .this Martha passed her
off as ber own child. At the period of the
death of Martha's infant she was living
with a man namt-d CJibbs, and therefore it
was that the child, Maria Suzrnna, was
brought up as Maria Suzunna Gibbs, which
name she, however, discarded on coming
of age, and being luformed of the facts nar

T The defendant, in his reply to the peti
tion of the plaintiff, admits her statement
to be true, as far as his catling her colored
woman goes, and calls upon her to prove
her status . This the complainant says she
is prepared to do, and so the matter stands
before his Honor Judge Reynolds, whose
decision in the matter will .'no doubt be
anxiously looked fur.
A. NOBLE SAILOR.
Tbe following instance of the noble con
duct of a true sailor Capt. Cameron, ol
the British schooner Atars, from New York
to SL John's, (N. F.) demands special
record, though it is the act of a skipper of
a fore-and-aft, coasting' schooner. ; Captain

whence the cries proceeded, firing guns
and keeping a bright light displayed in tbe
rigging to let the sufferers krfow that they
were heard. Soon made a wreck, which
proved to be the . schooner State of Maine,
Capt. Philbrook, of and from Frankfort for
Cardenas, dismasted and water-logged.
Having no boat that could possibly live in
such a sea, made continual attempts to res
cue the people of th wreck by steering the
Mars as close to it as could be ffone with
safety, and throwing line; with running
bowline knots to toward the men. . By

survivors, the weather , still very- stormy

their attention, but they hyl their course !
