Mr. Editor: As some misunderstanding of the law in regard to vaccination and at tending school has come before the public, I enclose you a letter from Br. My Dear Doctor: Yours of the 5th inst., notifying me of the presence of smallpox in oue townshiu of your county and of the fact that the Board of Health has ordered compulsory vaccination iu that tdwnship, extending the or der to any other township m which ctues of the disease should occur, and asking my opinion as to the rights qt the Salutary Committee in regard to the public school attendance, is received, . Aa 1 understand Section 5 of the act relating to the Board of Health as amended by the Oentral Assembly of lyui, the Uounty banitaiy Uom mittee are charged with the "care and responsibility of the health in terests of their county. They shall make such rules and regulations, pay such fees and salaries, and impose such penalties as in their judgment may be necessary to protect and ad vance the public health." No one will deny that schools with im vacci nated teachers and pupils constitute oue of the very best means of spread ing smallpox. It is, therefore, to my mind, entirely reasonable that the County Sanitary Committee should make such a regulation un der the circumstances and enforce it to the extent of closing the schools unless such a reasonable requirement is complied with. i In some states no child is allowed to attend the public schools at any time mless he has been successfully Vaccinated and it is certainly not unreasonable to require the school children of a community in which the disease is actually present to be vacciuated. I think that if you will show the Snpt. of Public Instruction Section 5 of the law, a copy of which I enclose, he will see that his position is untenable. I hope .sincerely that your County Sanitary Committee will not weaken in the least, but will insist upon car rying out to the letter the rules they have made in regard to the vaccina tion, aot only that regard to the school children, but of other persons who have not been successfully vac cinated in the ' past two or three years. Sec. 7 of an Act to Amend an Act Relating to the Board of Health, Chap. 214, Laws of 1893. That section 2-3 bo amended by striking out all of said section from the beginning of line ten and insert ing in lieu thereof the following : 'the sanitary committee of uny comi ty may make such regulation und provisions for the'vaccinatiou of its inhabitants and impose such penal ties as they may deem necessary to protect the public health ; and anv person violating such regulations shall be guilty of a misdemeanor and may be fined not exceeding fifty dol lars, or imprisoned uot exceeding thirty." Sec. 5 of An Act Relating to the Board of Health, Chap. 214, Laws of 1893, as A mended. There shall be an auxiliary board of health iu each county iu the State, whose fuuutiou shall be, upon the call of the chairman of the board of county coiu-jiiV siouers, to advise the bounty authorities in all mailers pertainiug to the public health. Thowe boards shall be composed of all reg istered physician resident in the county. Their term of ot flue shall bo conterminous with that of lh commissioners with whom they serve, an when on duty they shall receive the sum compensation as is receiveu by count,, commissioners. The county sanitary com mittee shall have the immediate care am responsibility of the health interests 01 their uounty. They shall make such rule and regulations, pay such fees and salaries, and impose such penalties as in tutir jud gment may ba necessary to protect and ad Vance the public health. And any person violating snob rules and regulations shall be guilty of a misdemeanor and may b lined uot exceediug fifty dollars, or im prisoned uot exceeding thirty days. They shall eicct a registered physician, not a member of the sanitary committee, to serve two years, with the title of county super inteudeut cf health, and shall fix his com pensation. The duty of the county super inteudeut of health shall be to carry eut as far as possible Buch work as may bo di rected by the county saniiary committee and by the State Board of Health. He shall always promptly advise the, Secretary ot the Stale Board of Health of the un usual prevalence of disease in his county, especially of typhoid fevr. scarlet fever, diphtheria, yellow fever, small-pox and cholera. He shall make the mad post-mortem examinations for coroners' inquests, atteud the inmates of the home for the aged and infirm aud the prisoners ia the jail or convict camp ef bin ooanty aud make examination of lunatics for commitment. He shall be the sauitnry inspector of the home aud jail, mcludiug convict camps, of his county, uaaliin,,' monthly reports to the board of couuty commissioners, aud to the Secretary of the State Board of Health.
