Notice is liereby given to all persons that the County' Boards of Health will prosecute any' person or persons who violate any of the laws or rules of I he Board of Health in regard to quarantine, and the law will be strictly enforced. So that no one can be ignorant we print the fol lowing: SECTION 1. Any person neglecting or refusing to comply with or in any way violat ing the rule promulgated by the county superintendent of health or the state board of health on the subjects of quarantine and disinfection, shall be deemed guilty of a misaemeanor, and upon conviction shall be fi-ed or imprisoned, at the discretion of the court, not less than live nor more than fifty dollars, or less than ten nor more than thirty days. In case the offender be stricken with the disease fi r which he is Quarautirable, he shall be sub ject to the penalty on recovery, unless in the opinion of the superintendent it should be omitted: Provided, that the custody and care of any child or other person may remain in custody of parent or family. When a house holder knows that a person within his family is sick with either of the dis eases enumerated in section nine, (which are, smallpox, diphtheria, scarlet fever, yellow fever, typhus fe ver and cholera) he shall immediately give notice tliereof to the health officer or mayor, if he resides in a city or in corporated town, otherwise to the. county superintendent of health, and upo-n the death or recovery or removal of such person, the rooms occupied and the articles used by him shall be disinfected by such householder in the manner indicated in section nine. Any person neglecting or refusing to comply with any of the above pro visions shall be deemed guilty of a misdemeanor, and upon conviction shall be fined not Jess than one dollar nor more than fifty dollars. C he is' called to visit is'inlected with sma'lpox, diphtheria, scarlet fever, typhus fever, yellow fever or cholera, he shall immediately give notice there of to the health officer or mayor, if the sick person be in a city or incorpo rated town, otherwise to the county superintendent of health, and if he re fuses or neglects to give such notice of it in twenty-four hours he shall be guilty of a misdemeanor and shall be lined for each offence not less than ten nor more than twenty-five dollars. And it shall be the duty of the said county superintendent, health officer or mayor receiving such notice of the presence of a case of smallpox yellovv fever, typhus fever or cholera within his jurisdiction to communicate the same immediately by mail or tele graph to the secretary of the state board of health. A tailureto perfprm this duty for twenty-four hours after the receipt of the notice shall be deemed a misdemeanor, and shall sub ject the delinquent upon conviction to a fine of not less than ten nor more than twenty-five dollars. The county superintendents of health, or the board of health in the several cities and towns where organized, otherwise the authorities of said cities or towns shall cause a record to be kept of all reports recelve,d in pursuance of the preceding sections, and such records shall contain the names of all persons who are sick, the localities in which they live, the diseases with which they are affected, together with the date and names of all persons reporting any such oases. The boards of health of cities and towns whereveT organ ized, and where not the mayors of ohe same, and in other cases the county superiniendent of health, shall give the school committee of the city or town, the principals of private schools and the superintendent of public in struction of the county, when the schools are in session, notice of all such cases of contagious diseases re ported to them according to the pro visions of this act. A failure to pei - form this duty for twenty-four hours after the receipt of the notice shall be deemed a misdmeanor, and subject the delinquent upon conviction to a fine of not less than ten nor more than fifty dollars. The school committee of public schools, superintendents of graded schools and the principals of private schools shall not allow any pupil to attend the school under their control while any member of the household to which said pupil belongs is sick of either smallpox, diphtheria, measles, scarlet fever,: yellow fever, typhus fever or cholera or mumps or itch, or during a period of two weeks after the death, recovery or removal of such sick person: and any pupil coming from such honsehold shall be required to present to thejteacher of the school the pupil desires to attend, a (^.riificate from the attending physi cian, city health officer or county su- nerintendendent of health the facts necessary to eutiile him to admission in accordance with the above regula tions. A willful failure on the part of any school committee to jierform the duty required in this section shall be deemed a misdemeanor^gind upon con viction sliall subject each and every member of the same to a line of not less than one nor more than tweniy- five dollars: Provideu, that the in structions in accordance v.dth the pro visions of this section given to the teachers of the schools .within twenty- four hours after the i-cceipt of each and every notice shall lie deemed per formance of duty on the part of the school committee. When a person coming to a city or a town from abroad or from some other place in this state [which] is infected or has lately been infected with either of the disea es mentioned in section nine, the lYal board of health where such exists, otherwise the board of aldermen or the board of town commissioners, shall make effec tive provision in the immner which it judges best for the safety, of the inhab itants by removing suc[ person to a separate house or otherwise, and by- providing nurses and .other assis'- anoe and necessaries, whicn shall be at the charge of the person himself or his parents, whore able, otherwise at the charge of the city, town or county to which he belongs. Any householder in whose family there is to his knowledge a person sick of cholera or typhoid fever, wlio shall permit the bowel disch.’-irges of such sick person to be emptiijd without first having disinfected the.il, according to I movul of a person sick of either of the flisefises ' loentioned, the rooms occupied and the articles used by the patient are thoroughly disinfected in tlie manner set forth in the printed instructions, both as to quarantine and disinfection, which shall be fur nished him by the secretary of the state board ol' health. The expense of the quarantine and of the disinfec tion shall be borne by the house holder in who.se famil.y the Case oc curs, if able, otherwise by the city, town or county of which he is a resi dent. The failure on the part of a county superintendent of health to perform the duties imposed in this section shall be punished by the de duction ol'five dollars for each day of delinquency from his salary by the board of county corninissioner.s; and if it shall appear to the satisfaction of the county board of health that the death of any person from the spread of the disease can justly be attributed to such failure of duty on his part, he shall be deposed from office and a successor immediately elected to fill out his unexpired term. And in oases where such undisinfected discharges are emptied on the water-shed of any stream or pond furnishing the source of water-supply of any public institu tion, city or town the penalty shall be a fine of not less than twenty-five nor more than fifty dollars, or imprison ment not more than thirty days. And any physician attending a case of cholera or typhoid fever who refuses or neglects to give the proper instruc tions for such disinfection as soon as the diagnosis is made shall be deemed guilty of a misdemeanor, and upon conviction shall be fined not less than ten nor more than fifty dollars. Whenever a:id wherever a nui sance upon premises shall exist which in the opinion of the county superintendent of health is danger ous to the public heallh, it shall be his duty to notify in writing the par ties occupying the premises (or the owner, if the premises are not occu pied) of its existence, its character and the means of abating it. Upon this notification the parties shall pro ceed to abate the nuisance, but fail ing to do this shall be adjudged guilty of a misdemeanor and shall pay a fine of one dollar a day dating from twenty-four hours after the notifica tion has been served, tie amounts so collected to be turned over to the county treasurer: Provided, how ever, that if the party notified shall make oath before a justice of the peace of his or her inability to carry out the directions of the superiuten dent, it shall be done at the expense of the town, city or county in which the offender lives. In the latter case the limit of the expense chargeable to the city, town or county shall not be more than one hund'ed dollars in any case: Provided further, that nothing in this section shall be con strued to give the superintendent the power to destroy or injure prop erty without a due process of law as now exists for the abatement of nui sances.—Laws 1893, cli. 214; Laws 1903, ch. 690. SECTION 2.
