It is further set forth in the instru ment of appeal that the president of the Brevard Banking company, in ac cordance with instructions of board of directors of said bank, approached one Henry N. Carrier, known to be the husband and acting as agent for the said Mrs. N. B. C. Carrier, and through false and misleading repre sentations, induced said Henry N. Carrier to purchase for her 100 shares of stock in said bank, paying therefor the sum of $15,000. The instrument declares that said Mrs. Carrier was not aware of the actual"* conditions of the bank until it had closed, nor had she been in formed previously of the fraud which had been practiced upon her; that as soon as the liquidating agent, when appointed, was informed " through agent of her repudiation of the pur chase of the stock because of the fraudulent manner in which it had been sold to her through her agent, I Henry N. Carrier. Mrs. Carrier asks, first: That herj subscription stock in Brevard Bank- ! ing company be cancelled; Second: That she have and recover from the said Brevard Banking com pany the sum of Fifteen Thousand Dollars, and interest thereon from the date when this sum was paid to said bank, and that said judgment be declared a preferred claim against said bank by favor of this defend ant, and Third: That the stock assessment and judgment filed against her in the office of the clerk of the court for Transyvania county be set aside and declared null and void.
