The General Assembly of North Carolina do enact: Section 1. The Board of County Commissioner of Macon County . shall constitute the Highway Commission of. Macon County; that said Board qf County Commissioners acting as said Highway Com mission, shall have full power and authority over all the roads and bridges of Macon County not under the jurisdiction and control of the State Highway Commission, with full authority and power to build construct, and. maintain all roads and. .bridges'-within said' County of Macon and to enter into any contract or contracts with the State Highway Commission either for the building and construc tion of anv highway or bridges within the County of Macon or the maintenance and upkeep of any highway or bridges in said County of Macon. That secetions three thousand six hundred and sixty-nine and three thousand six hundred and seventy-one. of the Consolidated . Statutes of North Carolina of one thousand nine hundred and nine teen, shall constitute a part of the road laws of the County of Macotu Section . That any road ol highway within said County, that the said Board of County Commissioners may, under this act, maintain and keep in repair, shall be known and designated as a principal road'. or' roads, whether said highway or roads are entirely maintained and kept up entirely by' said County Commissioners or in connection with the State Highway Commission nudcr any contract that it might enter into with 'said Highway Commission or any other person, and said Board of Count Commissioners are hereby authorized, directed and empowered to designate any road that they may see fit within the Countv of Macon as a principal road. or, highway: Provided, that such designation shall not in any way interfere, with or change the ( location of any highway -in. said County," located and designated by , the State Highway Commission. , ',.' Section 3.' That the County. Commissioners of ' Macon County are hereby authorized, directed and empowered to levy a special ad ' valorem tax of not lessthan ten cents nor more than twenty-five cents per one hundred dollars valuation of property -which. tax shall be- levied annuallv upon all the property of said County and shall be used bv said Board of County Commissioners solely for the purpose of building. construction, repairing and maintaining roads and bridges situated within the County of . Macon. That the special road x and bridge tax so levied under this section shall be kept separate from all other taxes and shall be known and designated as the County road and bridge tax. - . .' That the ' County Commissioners shall, on said -date and every year , thereafter, aopoint the successors in office of said trustees, and said Countv Commission of Macon County are. hereby given the right to remove anv one or all of the trustees so appointed for cause shown at'any'time; that the County Commissioners of said County . shall annuallv fix the pay of the said trustees so appointed by them, and make such rules and regulations for the conduct of Saul trustees as in the opinion of said County Commissioners would operate to the ; benefit of the roads of said County. That said trustees shall meet at once after their appointment and .organize by electing one ot then number chairman and one secretary, and shall torthwith report their proceedings to the Board of County Commissioners in writing, which report shall be filed with the Clerk of the Board in the ofiice of the Register of Deeds for said County. That the trustees so appointed ... shaU mect so often as it may be necessary for the transaction ot their business. The said trustees. shall proceed, at the first meeting after the appointment, to divide the roads of their township into suitable and convenient district and appoint supervisor or oyer feer' for each district and shall fix his pay.. It shall be tne duty of. each supervisor or overseer tmediately after his appointment to pu his section of road in good condition and to keep, the same in good cond"ffluring his term of office. The trustees shall alsc , be respon sible for the condition of the road in their township And at said first meeting shall appoint one of the number as road supervisor ot. their township, and fix his compensation, and the number of days, he shall serve each month, said compensation not to exceed two dollars per da v, same to be paid by the County Conmnss.oners ou of the same funds the trustee are paid from, whose 'duty i t shall be to supervise and oversee the roads of the township and report at : least once a month to said trustees the condition of the roads m the tOWSection 5." That if in the opinion of any board of trustees of any, township in Macon County, the amount of taxes so levied by the County Commissioners is in suffiicent for the' road work in their township, they shall petition the Board of County1' Commssipners of Macon County to levy an ad ditional special road tax for said township, and it shall be the duty of the Board of County Commissioners' to so levy such special road tax for said township on all the taxable property of said township , which special road tax shall be not less than five cents nor more than, .twenty-five cents on the one hundred dollars valuation of property, which tax.be kept': separate from all other taxes and shall be known and designated as an lixtra Special Rosfd Tax for the township in which the same is levied. That this tax may be levied at any time, and in each township where said special tax is so levied and collected, the treasurer of the , board of trustees shall increase his bond so As to, cover said special tax.' That said moneys. so col lected shall only be tysed within the towship in which it is levied and collected. . ' ' 1 . , Section 8. That the road trustees of each township in Macon , County are hereby vested with the right and duties of keeping the several, roads in their respective townships in good repair andex- pending the township road funds herein provided and shall also have the authority to build and construct any road wholly within their respective townships, but shall not have the authority to spend any x money for the bmid'ns or constructing of said roads other than what is levied under this act and known as the Special Township Road Tax, and the Extra Special Road Tax for the township m which the same is levied. . . Section 9. That all new roads constructed in the County ot 'Macon either by the County Commissioners or by the road trustees of any township shall be laid off and staked out by some competent engineer or surveyor. That after said road is so laid pif and staked out by a competent engineer or'surveyor, and his report filed citner . with the County Commissioners of Macon County or the road trustees of the township, as the case may be, then it shall be the duty of the .'.County Commissioners of Macon County or ot tne road trustees of the township as the case may be. to order a jury of three free holders to view said premises after notice to all of the properu owners through which said road runs, and assess such damages as .. mav be sustained, always considering the benefits arising to the owner of the lands, in the assessment of such damages. That said jurv shall file their report either with the ' board ol County Commissioners or the trustees of the township, as the case may be, and when said road is constructed by the Board of County Commissioner's of Macon .County, they shall pass on sa:d damage and either approve or disapprove same and allow such amount, as in their judgment would be proper, but from the order of said Board of Commisisoners' and the report of .said jury, cither party may appeal to the Superior Court of Macon County when- the question of suchnlamages shall be heard do novo. That it said road is built and constructed by the township trustees they shall pass upon the damages so allowed and allow such sum as in their opinion shall be proper and from their decision and report ot said jury either party may appeal to the Board of County Commissioners of -Macon County who shall pass upon said matters and render their judgment accordingly and from the decision of the Board of County Commissioners either party may appeal to the Superior Court ot Macon County where such case shall be heard do novo as - to the : question of damages only. That the question of damages shall in no wav hinder or obsturct the building and construction of said road, or 'roads either by, the Board of County Commissioners of Macon - County or townshrip trustees, but that said. roads shall bi built and constructed upon the orders of said Board, the same as if no question of damages had arisen and that said appeal shall only be allowed on the question of damages alone and not as to the budding or construction of said roads. '" , That all damages arising from the building or construction ot a road by the Board of. County Commissioners of Macon County, shall be paid out of the county road funds, provided for in i this act. SecMon 10. That any lumber company, corporation, person or persons engaged in the lumber business and desiring to use any cf S roads of Macon County for the purpose of carrying on .
