said defendant, L. C. Rouse, and his
property by Frank I. Murray, clerk'
superior court for Macon county,
North Carolina on the 12th day of
January, 1928, that said summons and
warrant of attachment arc returnable
before the Clerk of the Superior court
of Macon county on the 14th day of
February, ' 192s. That said cause of
action is for the sum of $1,192.30 due
the plaintiff by the defendant by
breach of contract arising in damages
by virture of the defendant having
failed and refused to comply with his
contract for the purchase of the home
place of the plaintiff situated on
Harrison avenue " in the Town of
Franklin, County of Macon and the
State of North Carolina. '

rie Pipkin, to T. V. Reece and wife,
Annie Recce, of date the day of
February 1926, to secure the purchase
price of the foregoing described land,

ment of the indebtedness secured , by
