Sur veyed the 21st February, 1918 The terms of sale are as follows : The successful bidder is to deposit at once, with the commissioner or with the court the sum of two hundred fifty dollars, either in cash or by certified check, the same to be applied on the bid should there- be a com pliance therewith, but should there be failure to comply therewith, then it shall be forfeited to the plaintiff and the premises resold on the same, or the next convenient salesday there after upon the same terms and at such bidders risk. One-third (1-3) of the accepted bid shall be paid into court in cash im mediately after the confirmation of tht; sale, the balance on credit, payable in three equal annual installments, with interest thereon at 6 per cent per I annum from date of sale till paid and secured by a first mortgage on the premises on the-part of the pur chaser.
