Wednesday's session of the Recorder's Court was a very busy one, it taking a full day to dispose of the docket. The case of State vs. Bill Henderson was tried by a jury. It was a closely contestee case. Solicitor Mc -Elroymade a masterly argu ment to the jury but the defend ant was acquitted. tn the case of State vs. S. O Goldsmith, for failure to work the roads, the court directed a verdict of not cuilty. "The case rested upon the validity of the ordinances of the town of v al nut., Before any plea was enter ed tn the case the counsel for the defendant made the point that the boundaries set out in the charter of the town were so in definite that it would be impos sible to establish the boundaries of the corporation and that for this reason and the further rea- ton that the Highway Commis Eion and bond act put all roads inside of incorporated towns in this country in the hands of the Highway Commission it would be impossible for the State to make out a case. HENDERSONVILLE, Jan. 9 The people of this section are awaiting with unusual "interest the announcement of the recent visit to the zircon mines at Zir conia, Henderson county, by Dr. Howard A. Kelly, the noted Baltiiriore surgeon, who is re cognized as being one of the country's greatest cancer doctors, who was here in search of ra dium with which he makes treat ment for his marvelous cures. Dr. Kelly" was accompained to t.h mines bv Dr. Levi Jones of Zirconia. He expressed himself as highly pleased with the pros pects for radium and took with him a number of specimens of zircon for assaying purposes These mines are the property of Capt. M. C. Toms of this city and his son, Charles French Toms of Asheville and were ope rated successfully about 30 years ago when zircon was a very pre cious product. Additional equip ment was installed about a year ago and operations resumed but owirg to the large quantity of such product now in the country the mines could not be success fully operated. Since radium is found only in zircon mines it is highly probable that further in vestigations will reveal the fact that there is an abundance yet undiscovered. Dr. Kelly was attracted to this place by the ex cellent output of zircon, being directed here by Dr. Joseph Hyde Pratt. A Difference' in Working Honrs.
