Frank The Supreme Court of Georgia has decided that Leo. M. Franks who -was convicted of the murder of little Mary Phagan must pay the price imposed upon him by the lower Court. His attorneys are, however, asking for a re hearing. Two of the Supreme Court Justices were for giving him a new trial and wrote dis senting oppinions in the case. Senator Gore Exonerated In the case of Mrs. Bond seek ins damages against Senator Gore of Oklahoma it required the jury but ten minutes to exo nerate Senator Gore. The suit was Drobably a frame up on the Senator by his political en emies who sought to destroy him but the jury has turned aside the turbulent current of malicious Dersecution and Senator Gore has passed the ordeal unharmed All honest people will rejoice in the Senator's victory. Road Routes Settled River Route via The Little Hurrl- can; Mars Hill Route, yia Dr. Tilsons. Two weeks ago, upon the state ment of a member of the High way Commission we reported that the Mars Hill road would be built around by Whitts. The Commis sion met Monday and adopted the middle route leading through by Dr. Tilsons. ; The course of the road leading to Hot bpnngs was also perma- should be given nently settled and the route via the Little Hurrican and Laurel was adopted. The Commission will begin, at once, to let contracts for the con struction of these roads. At least this is our information and In the case of state vs G. G. Metcalf for engaging in. the busi ness of selling spiritous liquors tried in the Recorder's Court Wednesday by Recorder Ramsey. Solicitor P. A. McElroy made out a very strong case for the State. After the state had rested the de fendant, through his attorney, E. Zeph Ray, announced that he would not resist a verdict in the case and appealed to the Court that the defendant be fined and not be sent to the roads of Bun combe County. It was argued that Madison County was fur nishing men to. build roads for Buncowbe County at the expense of the school children of Madi son County; that road sentences as shown by experience, do not always accomplish the reforma tion of persons upon whom they are imposed but that they had the effect of degrading those upon whom they are imposed and of crushing every laudible ambition. The further point was made that the defendant was willing to pay a fine and permit a second verdict of guilty" to be entered against him with a suspended judgment so that in the event the tine did not have the desired reformatory ef feet the defendant could be brought before the . court any time and further ! sentence imposed. The court imposed a fine of $250.00 and costs in both cases requiring the defendant to ap pear from time to time and show that he has been of good behavior. Quite a large number of the leading citizens of the county were present and have expressed their approbation of the course pursued by the court. It was brought out that the de fendant had never been in court before and state's witnesses testi fied than Metcalf was a man of good character. In cases of this nature we are of the opinion that the defendants a chance to re form and make better men.
