Bright Case Non Suited By Ervin -(Continued from pa;e one- New York co-eds intend to "marry men of brains, character, adequate incomes and nice sense of humor." It smacks a little of bigamy. The average school child has little idea of studying in order to be able to make a better living and the sad truth is that many school authorities have not better ideas on the subject. Miss Bright lacked 16 quality points, which were necessary before she could graduate. Judge Ervin discussed the motion from the bench, at length, saying that it was a novel case, and that he would like to have his ruling pass ed on by the Supreme Court. He could not agree, he said, that the de fendants had made any contract to give Miss Bright a primary B cer tificate. He continued, by saying that the state put the duty on Dr. Hunter as president of the college, to prescribe the course of study, with the ap proval of the state superintendent, and that there was no proof that Dr Hunter had prescribed any course of study and there was no proof that Dr. Hunter knew of what had been prescribed. Dr. Hunter and Dean Bird were rep resented by F. E. Alley, Jr., John M. Queen, of Waynesville, and Dan Moore, of Sylva. Johnson and Medford together with (rover C. Davis, all of Waynesville, represented the plaintiff. WED ELIVER PHONE 48 HAZELWOOD Justice H. Black Has Arrived Home Justice Hugo Black and Mrs. Black quietly boarded the steamer "City of Norfolk," at Southampton, England, last week for Baltimore where the vessel docked yesterday morning, bringing home from his vacation in Europe the man who for two weeks has been the Nation's greatest storm center. During more than a week in London since the storm broke in this country he had steadfastly refused to answer any questions regarding his alleged membership in the Ku Klux Klan, past or present. In Lon don he secluded himself in his hotel room and asked that visitors and tele phone messages be kept from reaching him. On the small steamer. City of Norfolk, likewise he asked for privacy during the eight-day voyage. Being interviewed upon his arrival Black declined to answer a point blank question as to whether he was a member of the Han. "When I have any statement to make on any subject I will make it in a way that cannot be misquoted, and so the public can hear it," he de clared. When asked if that meant a radio speech he said the press might fail to print some parts of his sta ti me tit. Unemployment Count To Be Finished Dec. 1 Afer a Hyde Park conference re cently, John D.
