Deadline For Soil Building Allowance Set For Sept. 15th Haywood county farmers who have not earned 100 per cent of their soil building allowance un der the 1941 Agricultural Conser vation program are urged to visit the county agent's office or con tact their AAA committeemen. Applications for lime and phos phate under the 1941 program will not be received after the 15th of this month, so all farmers who have not made application to date are urged to do so in the next week. Small pox, formerly one of the major causes of death in the United States, now takes only about forty lives per year, according to the Census Bureau. MRS. MORGANTON. Hilliard Cald well 22-year-old Richmond man was bound to Superior court here on a charge of manslaughter growing out of the death of his mother in an automobile wreck here recently. In a preliminary hearing, Mag istrate T. Earle Franklin found probable cause of guilt and order ed the case set for trial at the next criminal term of Superior court. Bond was continued at $500. Caldwell admitted he was driv ing the Plymouth sedan which collided with a large tractor-trailer type truck operated by the Ma son and Dixon Lines of the west ern outskirts of Morganton about 5:20 a. m. His mother was fatally injured, and another occupant, Jim P. Harding, of Canton, a Marine stationed at Quantico, Va., received injuries which kept him in a hos pital until Wednesday. The young man appeared for the hearing with his face still bandaged from minor cuts he re ceived in the crash. He was ac companied by his father, Cordell Caldwell, of Richmond, Va., and other relatives, and was represent ed by Attorney O. Lee Horton, of the local bar. State's witnesses included Rural Policeman Roy Morrison and Po- lice Officers I. N. Ramsey and C. A. Fox who told of going to the scene of the wreck, the "Patton curve" on Highway 70, just west of the city limits. No evidence of drinking was offered. Officer Mor rison told of finding about a half quart of liquor some distance from the car but said he did not know whose it was or where it came from. The truck was said to have been on the right side of the road, with its right front wheel off the center line in the highway. Joe Brown Whitson, driver of the truck, said he was proceeding east up-grade at a speed of six or eight miles an hour when he saw the auto rounding the curve at what he estimated to have been a speed of 50 mile's an hour. He said he turned as far to the right as he could in the brief time and slapped on the brakes, bringing the large truck to a standstill before it was hit.:-- Caldwell took the stand in his own defense and told of taking the steering Wheel after a stop at a service station in Morganton. Dark at that hour, the atmosphere was thick with fog, he said. He es timated his speed 'at not over 35 miles an hour when, he said, the lights from the truck blinded him as he rounded the curve and he "just couldn't pull it (the car) over far enough." The auto was virtually demol ished in the collision . which ac counted for the only fatality to oc cur in Burke county during the Labor Day week-end. Wins 20-Year Battle To Save Ancient Oak ALBANY. N. Y-Thomas Vos- burgh has won a 20-year fight to save an ancient oak tree near his home in Rensselaer. The tree, estimated to be 200 vears old. completes a fine scenic view from his house and Vosburgh has stood off all comers attempting to remove it: First a lumberman began to clear the virgin woods by which the tree stood, Vosburgh bought the single oak for $25. Then he got a promise from the landowner that the tree would stand. Years passed and the city bought the land. Then persons began dump ing refuse around the tree. The the WP A came along and proceeded to clear the land. Vos burgh stopped them when they came to the tree. Finally the tree lover determined to end the threats.
