Review
An important measure of the
highway safety program passed by
the 1947 C.eneral Assembly was the
motor vehicle safety and responsi
bility act which was endorsed by
the Carolina Motor club. Coleman
W. Roberts, club president, has had
Ihis progressive legislation con
densed into a series of questions
and answers to help the motorists
of North Carolina fully understand
the bill.
Governor K. Gregg Cherry, in
his address to members of the Gen
eral Assembly in January, called

lowing questions and answers con
cerning this bill will do much to
clear up some of its details for
motorists, who have not had lime
to study this measure closely.

Answer: The purposes of this act
are to promote greater safety in
the operation of motor vehicles in
his state and to require financial
responsibility of reckless, ineffi
cient and irresponsible operators
of motor vehicles.
3 Question: Does this bill require
that automobile liability insurance
be carried?
Answer: No; the bill does not
require this insurance be carried
but by carrying insurance one pro
tects against any penalties of the
act.
4 Question: If a person never
had an accident and was never ar
rested, does this act have any pen
ally'.' Answer: No.
5. Question: How may proof of
financial responsibility be fur
nished? Answer: '1 If an individual has
automobile liability insurance he
can meet the financial responsibil
ity requirements of the act.

ties or real estate in such amounts
as the commissioner may decide,
subject to a limit of $11,000.

contained in this act bring owners
and operators of motor vehicles
under the act?
Answer: il) Section 7 provides
any person whose operator's or
chaulTcur's license has been re
voked or suspended under the pro
visions of the Uniform Driver's Li
cense Act, shall not be entitled to
have his license reinstated until
he has given and thereafter main
tains proof of his financial respon
sibility. (2) Any person convicted of and
any person forfeiting bond in con
nection with any offenses set forth
below shall have his license re
voked for at least one year and
shall not be reinstated until such
person gives and thereafter main
tains proof ot financial responsi
bility.
1. Manslaughter for negligent
homicide i resulting from the op
eration of a motor vehicle.
2. Driving a motor vehicle while
under the influence of intoxicat
ing liquor or narcotic drug. '
3. Any felony in the commission
of which a motor vehicle is used.
4. Failure to stop and render aid
ns required under the laws of this
state in the event of a motor ve
hicle accident.
fi. Perjury or the making of a
false affidavit or statement under
oath to the department under this
article or under any other law re
lating to the ownership of motor
vehicles.
6. Conviction or forfeitures of
bail not vacated upon two charges
of reckless driving committed with
in a period of 12 months.
7. Conviction or forfeiture of bail
not vacated upon on charge of reck
less driving while engaged in the
illegal transportation of intoxi
cants for the purpose of sale.
(3 1 Any person who has been
legally adjudged insane, or a con
genital idiot, an imbecile, an epi
leptic or feeble-minded, or who has
been committed to or has entered
an institution as an inebriate or a

son's license and registration shall
not be returned unless the com
mission is satisfied that he is com
petent to operate a motor vehicle
and only then if he gives and there
after maintains proof of his finan
cial responsibility.
(4) That the commissioner shall
suspend the operator's or chauf
feur's license and all of the regis
tration certificates and registration
plates issued to any person who
has failed for a period of 60 days
to satisfy any judgment for more
than $50 for damages because of
injury to or destruction of prop
erty, including loss of its use, or
any judgment for damages, includ
ing damages for care and loss of
services, because of bodily injury
to or death of any person arising
out of the ownership, use or opera
tion of any motor vehicle.

of an unpaid judgment reach the
commissioner of motor vehicles?
Answer: the clerk of the court,
when it has no clerk, must forward
within 15 days, a certified ropy of
any convicilion. forfeiture of bail
of judgment which has not been
paid as provided for by this act.
10. Question: If a .judgment Is
rendered against an individual
growing out of an automobile acci
dent and he makes no effort to
make payment, will he ever be able
to drive an automobile again?
Answer: No. he will never he
able to obtain a driver's license
again.
11. Question: May a person re
move a judgment by bankruptcy?
Answer: A dv ;iarge in bank
ruptcy shall not relieve the indi
vidual' from any requirements of
this act.

Answer: Yes, after hearing if he
determines the individual:
(a) Is incompetent to operate a
motor vehicle.
(b) is afflicted with mental or
physical infirmities or disability
rendering it unsafe for him to
drive a motor vehicle.
(c) is habitually a reckless or
negligent driver.
(d) has committed a violation of
the motor vehicle laws of this state.
(e) is a habitual drunkard.
(f ) is addicted to the use of nar
cotic drugs.
13. Question: How will this act
benefit people injured in automo
bile accidents in this state?
Answer: It will provide payment
for all injuries where there is legal
liability or the individual responsi
ble will never be able to operate
a motor vehicle in this or any oth
er state with a similar law, except
as noted in 2 and 3 under answer
to question 7.
14. Question: Is this legislation
in effect in any other state?
Answer: Yes; similar laws are I
now in eltect in tne toiiowing
states: Illinois, Indiana, Kentucky,
Maine, Maryland, Michigan, Minne
sota, -Nebraska, , New Hampshire,'
New York, Oregon, Pennsylvania,
Vermont, Virginia and Wisconsin.
15. Question: What will be the
effect of this law if a North Caro
linian is involved in an accident
while driving in another state?
Answer: The same as if he were
driving In North Carolina, and he
will be subject to laws of the state
In which he is traveling as they
effect motor vehicles and financial
responsibility.
16. Question: Will proof of finan
cial responsibility accepted by
North Carolina be accepted in oth
er states?
Answer: Yes.
17. Question: What effect does
this law have on non-residents op
erating motor vehicles in this
slate?
Answer: the same effect as if
they were residents.
18. Question: If a deposit of $11,
000 in cash is made to show proof
of financial responsibility, can this
money be returned to the individ
ual? ,
Answer: Yes, unless it is needed
to pay off judgments against the

19. Question: Why has the new
safe responsibility bill been passed?
Answer: For many years past
the automobile accident problem
has been growing more serious and
many solutions for it have been
studied and considered. It is in
tended that this law should en
courage motorists to be careful and
responsible, increasing safety on
the highways, and providing for
the protection of automobile acci
dent victims.

He was address
ing a civic club
c o n v e n tion to
which he was a
delegate as president of his local
club. His ability to overcome his
handicap, and reach the important
post of president of his club was
a tribute to ability and determina
tion. He made a moving plea for the
disabled and handicapped. He said
that one out of every five persons
in the United States was either dis
abled or handicapped; that one out
of severi needed rehabilitation;
that on'! out of eight had a disabil
ity which was more or less perma
nent. There are now 85,000 dis
abled civilians and 228,000 disabled
veterans in the United States avail
able for reemployment. Of these,
he said 100,000 disabled veterans
I are now under training.
The disabled veteran wants a
job which gives him the dignity of
self-support. He has earnea h,
and is willing to work for it, and
to maintain it.
The federal and state govern
ment is providing increasing serv
ice to enable the disabled ana the
handicapped to train for employ
ment by which they may earn their
livelihood. Any disabled civilian
or veteran can learn of this service
through the welfare agencies or
veteran's organizations.
The time was when these handi-
capped people were considered a

they can move in society as normal
people and not as objects of sym
pathy and pity. Let's give them
what they ask and what they de
serve, a fair chance. During the
war, they were in our prayers, or.
bond campaigns, in our letters. Now
they deserve to be in our thoughts
and plans. They eminently deserve
a fair and large place in our econ
