The eboved named defendants, SD Live Poultry Company, Inc., and Meyer Shechter' will take ' notice that an action aa above entitled has . been '; commenced against them in the Superior Court of Duplin County, North Carolina,- and that two several warrants of attachment each in the sum of Two Thousand, 'Seven Hundred Fifty Eight and 65-100 Dollars have been issued in said action by the said Superior Court against the property of the said defendants in the State of North Carolina, one of said warrants of attachment dated February 5th, 1940,' issued to the Sheriff of Du plin County, and levied by him on one truck load of -live chickens, the property of the said .defend ants, of the estimated value of K Two Thousand Dollars, the other of said warrants of" attachment issued by said Superior Court to the Sheriff 'of Beaufort County, and levied by him on the residue of a truck load of live chickens the property of the defendants, and of the estimated value of Five Hundred Dollars, which said two truck loads of chickens, or the pro ceeds thereof are being held by the said respective sheriffs to abide the final judgment of The court - - The said defendants will fur ther take notice that the 'purpose of the said action as above, is (or the purpose of the plaintiff above named to recover of the defend ants above named; the sum 3f Two Thousand Seven Hundred Fifty Eight and 65-100 Dollars, with in terest from January 14. 1946. due by the said defendants to the said plaintiff for the delivery to the said defendants by the plain tiff at their place of business in Brooklyn, New York, of one truck load of live poultry, being 2104 live chickens, ; weighing' 10635 pounds, the property of the plain tiff, for which the defendants then and there agreed to pay the plain , JOSEPH B. Further more, I am thoroughly familiar with the outside duties of this office, having participated on many occasions in ihis phase of the work as well as having just lately returned from the Army where I served for sometime as a Provost Marshal. . ' The said defendants will further take notice that they nd each of them are required to appear at the office of the Clerk of the Su perior Court of Duplin County, in Kenansville, North Carolina, on the 29th day of March, 1946, and answer or demur to the complaint in said action now filed in said Office, and enter such objections as they may be advised to said warrants of attachment, also re turnable on said last mentioned date, and if defendants fail so to do, the plaintiff will after twantj days from the expiration of said date, apply for the relief demand ed in the complaint, and ask that said property so seized under said warrants of attachment be applied to the payment of said debt and costs and charges.
