Its membership now numbers more than 165,000 farm families. The Motor Vehicles Department today issued a directive to it's field agents to be on the lookout for cars and trucks being offered for sale with concealed or altered iden tification numbers. Motor Vehicles Commissioner in ward Scheldt took steps to stop tne practice of concealing identi fication numbers, which some nor. sons and firms are reported' to be doing. " The practice stems from what has been called "car baptlegglng", Scheldt said. Some firms reported selling used cars and representing them as news cars are allesredlv concealing or altering the numbers io prevent laentuicauon. Scheldt indicated the Denartment of Motor Vehicles had no interest in the so-called . bootlegging other than the wilful alterinv nr concea ling of identification numbers. He said the law clearly covers his action in ordering the practice stopped. THIS IS , A "crime" is any act, or conduct. which has been, declared a crime by the State and tor which the individual or group responsible may be quickly punished .either by fine, or imprisonment, or both. North Carolina divides crime in to two general classifications: Mis demeanors and felonies. A felony is a crime which is or may be pun ishable by either death or imprls ment in the State's prison. Any other crime is a misdemeanor: The distinction-between the two classlficiations of crime is import ant foe several reasons. , Not the least of these is the' fact that one convicted of a felony loses his citizenship and its attendant rights, Including the right to vote or hold public office. A person convicted of a misdemeanor is not so severe ly penalized. Citizenship lost upon conviction of a felony may be re stored by law (outlined in Chap ter 13 of the General Statutes.) Petition For Citizenship A convicted felon, after he has served his time or paid off, may get back his citizenship by filing a petition in the Superior Court, setting out his occupation since his release and the reasons why he believes he should be reinstated as a full-fledged citizen. The felon must wait two years after release before filing this petition. Then the qlerlc of court must advertise the fact that a hearing on the pe tition is to be held, so that those who might oppose therestoration could appear. On the actual hear ing before the Superior Court Judge, the felon must prove by "five respectable' witnesses" that his "character" for truth and hon esty has been good for three years. The difference . between felony and misdemeanor is also Import ant because there is no time limit against prosecuting felonies. On the other hand, the time limit aft er which a person may not be prosecuted for a misdemeanor Is two years. , This means that if one commits a simple assault or an ordinary trespass (which are mis demeanors) and the S&te fails to prosecute for two years thereafter, Vehicle with the identification num bers altered, removed, covered or concealed."' 4 vv ' Scheldt also said that some firms were not giving purchasers title papers with the seller as owner et the vehicle. However, if one commits murder or any other felony, he may be prosecuted for ft at the pleasure of the State, no matter how much time might have elapsed before the criminal action is started. v Offense Against State All crimes are offenses against the State. They are Infractions of State laws, or, the "common' law" which is unwritten.' It is for this reason that criminal cases in all courts are labeled "State (of North Carolina) v. John Doe (defend ant). " The General Assembly and certain administrative agencies over the years have determined what kind of conduct, shall constitute crime. It was the General Assem bly; which; determined that rape, first degree' murder, burglary, and arson are . "capital crimes," pun ishable by death in North Caro lina: Kidnapping is punishable by life imprisonment Double, Jeopardy The Federal Constitution protects the individual against "double jeo pardy" trial more than once for the same offense. On this point the question arises' When does the protection ot the double Jeopardy provision begin to work? When is a trial a trial, after which the State cannot quit and begin again later, or after which the State can not again prosecute the defendant on the identical evidence?" Gen erally, it may be said that a de fendant has been placed in 'jeo pardy' after the jury has been Im paneled and the defendant arraign ed. If the State goes this far in prosecuting an accused person, it cannot later try the same Individu al again for1 the original offense, unless the trial judge finds facts legally sufficient as a basis for or dering a mistrial. In such case, the accused could be tried again for the same offense. The accused could also be tried again if a mis trial in the first hearing should be ordered on motion of the accused, himself. A person accused of a minor prime which can be tried by a Re corder's Court or a Justice of the Peace may plead "not guilty" and yet have his case heard by the Judge without a jury. TJhis is not true ot cases heard in Superior Court. There, every case In which a plea ot "not guilty" is entered MUST be heard by a jury. Isenhower, State Di rector. , Mr. Isenhower had Just returned from a meeting at Atlanta, Ga., where the new steps to decentra lize and streamline agency opera tions were explained by Washing ton officials. In accordance with Secretary Benson's policy ot placing more control of agricultural programs in local hands, many of the decisions formerly made in state offices will now be made in counties. County Supervisors, the employees who deal directly with the farmers, will have final approval on a large number of loans and will have more authority in working with other creditors and in taking steps to help borrowers solve their fin ancial and farming problems, he said. Greater use will be made of state and county committees. New state committees, to be appointed in the near future, will be called upon frequently to review agency oper ations and made sure they are ef ficiently serving local needs. Coun ty Committeemen will be relied upon to an even greater extent than in the past to help adapt na tional policies to local needs. Services of other public and pri vate organizations will be used to the maximum extent possible. Coun ty Home Demonstration, agents will help Farmers Home Administration borrowers with their family living problems. Every possible step will be taken to make sure that no gov ernment funds are advanced when private or cooperative credit is available to meet the needs. Lend ers will be urged to supply funds tor insured farm ownership loans. State Directors and their staffs are being urged to Increase their efficiency by eliminating every un necessary step and doing a perfect job the first time. Measures already taken by the agency to render service at less cost includes the reorganization of the national, area finance, and state offices which resulted in a saving of more than $3,500,000. No attorney can properly defend against an alleged crime unless he is given all the facts within the knowledge of his client. A person accused of crime should have no qualms about telling his lawyer truthfully everything he knows about the case. The attorney's re lationship with the client is com pletely confidential. The attorney within the law the interest of the client. Remember these facts if you are ever accused of a crime. They could easily be the difference between prison and freedom.
