Homes, executrix, ask ing $100,000 damages tor the - death of her hubsand, Troy ' E. , Homes, employe of Edwards-Jernlgan Com Named as defendants In the suit ar Goldsboro''' Gas Company ;A and Town and County Gas Company. Homes, one of five persons killed in the explosion, was found buried in the basement of the . furniture store, where the explosion alleged ly originated. . ' ' The complaint -allege that there was situated near the Edwards-Jer- nigan ' building cellar a gas main and a number of pipes Installed for the purpose of furnishing artificial ?as to customers of the gas com pany and that the type of gas sup plied was the type that upon escape would settle in any part of the cel lar. r-:.y . : ; , The plaintiff charges that the de fendants were aware of "obsolete, ieterloated, rusty pipes filled with ?a furnished , by Goldsboro Gas Company, which were leaking gas, and nevertheless the defendants negligently failed to correct and remedy this defect." The gas company is charged fur ther with continuing to use Its "ob solete,' worn-out pipe system" and that it "neglected to inspect and test the pipe system maintained at Edwards-Jernigan, even though it had knowledge of the leaking gas." Attorney for the plaintiff is Paul Edmundson. We are sorry that Mrs. A. T. Dail is ii tne sick list. We are glad to report that Mrs. Joe Herring is improving.
