The injunction suit of Dixon v». the town of Gastonia wan decided bv Judge Robinson in Charlotte last Tuesday afternoon in favor of the town. The decision was in iht na tnre of a continuance and one on which the judge says he proposes to t*ic* out u cutout* The sewerage at present empties in the Davis branch this side of the Dixon lands, but both branch and creek carry the sewerage across the Dixon property. The decision of the court virtually give* Mr. Dixon the option of allowing the town to run the sewer pipe underground across hi* lands and turn the sewerage into •he creek below the Dixon line or of allowing the sewerage to flow across pro-senl In the opeo streams. If Mr. Dixon grants the right of way the town la required to pat down the pipes. If he iloesn't. then the pres ent sewerage routs will remain un changed. The Injunction is continued until next Satunluy week, April 7.- If the town at that time shall show to the court that it has been allowed to lay pipes across the Dixon lands and shall satisfy lha court of Its purpose to lay such pipes as will take the sewerage underground and empty It in the crack below the Dixon line, or if the town shall satisfy the court that such right of way has been re fused, then, fn either ease, the in junction wilt be declared dissolved. The town has on hand enough pipe, perhaps, to go across the Dixon property.
