The oldest is scarcely more than 15 years of age The offense with wnico tney : were cnarged was committed on 'Thursday night about 9 o'clock. ' The boys tied a waxed string to one of the windows at Mr. Davis' home, so the story goes, and with this and possibly other instruments of uoisemakifig nature, m a d sounds wbicb mentened some of the members of the house hold considerably. Miss Mamie Davis, it is said, suffered a ner vous shock as the result of which she has been confined to her bed most of the time since. The mavor taxed the boys with fine of $5 each and the costs and required them to pay the doctor bills incarred as a .result of their escapade, Yesterday afternoon there was a -mm - a a. a Jong-drawn-out trial at tne city ball before : Magistrate Thomas H. White. Though there was a formidable array of -i witnesses the trial failed to develop any very startling ' features. Will Guess, a negro fireman . in the engine room at the Loray, was charged ' with an assault o n Frank Barnes, a white painter who lives in that section of town Ihere was a wearisome amount of trivial detailed evidence. It was claimed that Guess had drawn a pistol on Barnes, for one thing. Several character wit nesses were put on the stand and some of the testimony was amusing to say the least." Barnes was represented by I. F Long and F F Griffin defended the negro Gness. Magistrate White fined Guess $5 and the cost for simple assault. His attorny a a a gave notice ot appeal and bis bond was fixed at $100 This morning Guess paid the fine and rcosts, amounting to $22. A penalty suit, set for trial be fore Magistrate White yesterday afternoon, t was : compromised. I. F. Long was seeking to re cover $50 from the C. & N.-W. Railway, $56 on a penalty-for-de- ay charge and $6 foe damage. The case did not come to trial, however, a compromise being effected by the payment to Long by the railroad of $12.50 Attor ney G. W.
