Inflammatory and damaging al
legations made in a suit against
the Great Atlantic and Pacific
Tea company at Dallas, Texas,
were so baseless that the federal
judge “threw the anti-trust law
yers and their case right out of
his court,” the company will say
in advertisements this week end.
The advertisement, scheduled
for publication in 2,500 newspapers
throughout the nation, was the
third in a series discussing form
er court cases where federal
judges found there was no evi
dence against the company and
administered stinging rebukes to
the anti-trust lawyers. 'F'
In the Dallas /anti-trust suit,
the ad states, the anti-trust law
yers “ntede practically the same
allegations they are making today”
in their current suit to break up
the 90-year-old food store chain.
Federal Judge W. H. Atwell,
the ad states, ixiled that the Dallas
case “should not' even be tried”
because the indictment “contain
ed inflammatory statements he
would not allow to be presented to
a jury.”
“If I thought I was presiding
over a court and that I might have
to sentence some person because
he was a great big fellow, or be
cause he was a lilliputian, I would
feel like resigning,” the ad quotes
Julge Atwell.
“God knows we don’t want it
ever to occur in America that the
size going to determine whet
her i man is guilty or innocent.”
Judge Atwell, the ad also says,
told the anti-trust lawyer^“if
the indictment is not good then it
is better to find out before
an expensive trail than it is
after an expensive trial. I do
not think it is good, and thinking
that, it is my duty to sustain the
demurrers and motion to quash.”
Cautioned “the third time the
anti-trust lawyers were wrong,”
the advertisement reviews two
other actions — the Washington,
D. C. bread case and Wilson, N.
C., potato case — in which fed
eral judges found no evidence to
support “damaging” charges bro

in increasing numbers and in
creasing volume,” the ad says.
“Apparently most Americans do
not want to let the anti-trust law
yers in "Washington blow the
whistle on any businessman who
does a better and more efficient
job and grows big iri the process.
“No one can make them believe
it is a crime to try to sell the best
quality food at the lowest possi
ble price.”
