To Not Guilty Of Assault
King Henry Love, of Ri. I,
Raeford, went to Dlstrit Courl
to plead guilty to assaulting an
84-year-old nan with a pocket
knife, but after hearing the
testimony, Judge Joseph
Dupree had the guilty plea
stricken and found him nut
guilty.
After pleading guilty, Love
testified that Tom Mcintosh
had pointed a loaded shotgun
at him and when he grabbed
the gun, he and the old man
had fallen and Mcintosh had
been cut on ihe chin. Love said
he had a pocket knife in his
hand when he reached for the
gun.
Judge Dupree questioned
Mcintosh, who al first denied
and then later said he did aim a
shotgun at Love.
Before passing judgement,
Judge Dupree explained to the
crowded courtroom why he
had spenl so much time on a
routine assault case in which
Ihe defendant had already
pleaded guilty.
"This tnan (love) is accused
of assaulting an 84-year-old
man and if I had found that to
be the case, I would have given
him every day the law allowed.
But because I wanted to make
sure before sending a man off
to prison, I have giuie into the
matter in some detail and on
hearing the testimony. I am
convinced thai the cutting
happened in the way the
defendant said u did -? "this is.
accidentally, as a result of a
scuffle.
"No one should ever come
to courl and plead guilty to a
serious offense unless he is. in
fact, guilty. And one one
should never conic to court for
a serious o f f e n c s e
unrepresented.
It takes a tool to represent
himself," Dupree said.
"Alter hearing the witnesses
in this case, the court is of an
opinion that the defendant is
not guilty and orders the
defendant's plea of guilty
stricken and enters a plea of
not guilty for the defendant."
Love was found not guilty.
David Propst of Rt. 2.
Raelord was found not guilty
of maintaining a nuisance and
Randy Propst. Ins son. was
found not guilty of trespess.
Asron Smith and Aaron Smith.
Jr.. prosecution witness, were
found guilty of I'rivolious and
~ malicious prosecuting and were
ordered to pay the courl costs.
They also spent most olthe day
in jail, wailing loi Judge
Dupree to render j vcidict. I he
charges brought by the Smiths
stemmed from a I cud o\ei a
roadway across the Smnh land
to ihe Propst home. Two
weeks ago. Judge Dupree
ordered Smith not to interfere
with the use ot the road until
the matter is decided in a civil

Lewis C. Cunningham of
Raeford pleaded not guilty bul

special permit for excessive size
and weight by not having a
patrol escort and exceeding the
specified height. He was
sentenced to 30 days
suspended and fined S25 and
costs. Cunningham gave notice
of appeal and bond was set at
$50. fie was found not guilty
of disobevine a mod sign and
failuie to yield right-of-way at
a stop sign.
Del ton Monroe, Jr. of Rt. I.
was given a four month active
sentence for assaulting his wife,
Wilma. He was also sentenced
to foui months during the
Superior Courl session last
week for assaulting his wife.
The new sentence is to begin at
the expiration of the sentence
from Superior Court.
The suspended sentence
given to Bobby Cliavis was
revoked and he was given a two
year active sentence for
violation of his probation.
Hubert Gates of Bowmore
was found guilty of
non-support and was sentenced
to six months suspended for
five years on the condititon
that he pay S25 a week child
support.The court reserved the
right to modify the payments
at anytime during the ne?t five
years. Court costs were
remitted.
James Buster Morrisor of
Raeford was jailed for two
weeks for eontenirM of court
after coming to court
intoxicated and registering a
.25 on a breathalyzer test
which Judge Dupree ordered
administered Friday morning.
He is charged with driving
under the influence and
possession of non-tax-paid
liquor.
James McLeod of Rt. I,
Raeford. was found guilty of
possession of liquor for
purpose of sale and was
sentenced to six months
suspended for three years on
the condition that he violate
no state penal laws for the next
three years He was fined S25
and costs.
Neill Junior McMillan of
Shannon was found guilty of
assault and was sentenced to
30 days suspended with capias
and no commitment to issue at
anytime during the next three
sears if he is convicted of any
violation of state penal laws.
McMillan was ordered not to
go lo his father's home or to
molest him in any way and was
charged court costs.
Prayer for judgement was
