In District Court Judge Frees Driver Not Advised Of Rights A 63-year-old man was acquitted of a hit and run charge Friday in District Court after Judge Joseph E. Dupree ruled the man was not properly advised of his legal rights prior to questioning. Malcolm White, Rt. 2, Raeford. had been accused of leaving the scene of an accident, drunken driving, and failing to reduce speed to avoid a collision after John D. Black claimed his car was struck from behind by a green Ford while preparing to make a turn from 401-A. Black testified he could not see who was driving the car, but went to get a friend, county coroner Frank Crumpler, and later locate^ the car and noted a damaged fender. Crumpler, who was called to testify next, said he was present when Trooper K.W. Weston came to White's home to investigate and Crumpler testified "the very first thing" Weston did was advise White of his legal rights. However, Crumpler said he didn't remember exactly what the trooper said. Weston testified he advised White of his legal rights, not immediately, and his account of the rights included the phrase, "If you can't afford an attorney, the state would try to appoint one". White's attorney, Philip Diehl, ?immediately motioned for a dismissal based on the Miranda ruling of the Supreme Court. Dupree granted the request, telling the courtroom action should be taken to insure highway troopers make use of printed cards setting forth the prescribed wording of a defendant's legal rights. Also, Friday, Billy R. Locklear, 22. of St. Pauls, waived a preliminary hearing on three counts of breaking and entering and larceny and three counts of receiving stolen property and was bound over to the grand jury. Bond was set at 510,000. Also headed for the grand jury are charges against Jerry Scott of Raeford, and Tommy L. Barnes, Rt..2, Raeford, after the pair waived a hearing on a charge of credit card theft. Bond was continued for each. Welton Locklear, Rt. 3, Red Springs. was cleared of assault with a deadly weapon with intent to kill (ADWITK) after a finding of no probable cause. Two persons pleaded guilty to drunken driving and the state withdrew two cases of DUI Friday. William R. Beckwith, Rt. 1, Raeford, was handed a $500 fine along with a six month suspended term, a 3Vi year probation period, and orders to give up his license for one year. A Breathalyzer reading was listed as .21. Also pleading guilty to DUI was Sylvester Covington, Rt. 1, Raeford, after the, state dropped a second charge of speeding. He was given a suspended OO-day term, fined $150, and ordered to give up his license for one year. A limited driving permit was granted. Blood alcohol level was listed as .15. Those pleading guilty to lesser charges after DUI was dropped were Belton Day, Rt. 2, Raeford, reckless driving, having no license, and inspection violation, prayer for judgment continued (PJC) until Feb. 14; and Billy R. Collum, Elizabethtown, driving left of center. PJC upon payment of costs. Several defendants were found not guilty of various charges. They were Terry W. Caulder, 614 Main St., Raeford, two counts of trespassing; Jeffrey S. Sorn, Marysville, Wash., trespassing; Steven Short. Ft. Bragg, trespassing; ana Joe E. Maynor, Rt. I, Raeford, injury to personal property. The prosecuting witness in' the latter case was ordered jailed until court costs were paid. Will McLean. Rt. 1, Raeford, pleaded guilty to ADW in a charge growing out of a dispute with Bud Brown,Gen. Del., Raeford, and a 30-day term was suspended upon payment of $20 restitution to Brown. McLean was found not guilty of a charge of injury to personal property involving a light fixture belonging to Brown, and Brown was ordered jailed until court costs paid for frivolous and malicious prosecution. Sheppard Cummings. Laurinburg, was found guilty of assault on a female and a six-month term was suspended for two years and $50 restitution payment ordered. Debra D. Hall, Raeford, pleaded guilty to consuming alcoholic beverages in public and a ten-day jail term was suspended upon $10 fine. Timothy L. Watson, Rt. I, Raeford, pleaded guilty to assault and the prosecuting witness, Donald E. Smith, was ordered to pay osts. Melvin Parkins. Green, Rt. 2, Raeford, no registration and no financial responsibility, PJC to Jan. 24; Thomas W. fate, Rt. 1, Raeford, no operator's license, no registration, no finahcial responsibility, 12 month term suspended for three years, no driving until licensed, $50 fine; Daniel Turner, Zebulon, speeding 68 in a 55 mph zone. S10 fine; James Joseph Ratchford, Jr.. speeding 65 in a 55 mph zone. PJC upon costs. Found not guilty was Johnny H. Sellers. East Laurinburg. charged with allowing unlicensed person to drive and allowing person under influence of liquor to drive. Nol prossed with leave by the slate was Larry Bullard. Rt. 4. Red Springs, for non-support. Glenn Miller, P.O. Box 842. Raetord, pleaded guilty to six worthless checks to Wood's Store totaling S218.81. Milter was handed two suspended 30-day jail terms and ordered to make restitution. Also pleading guilty to worthless checks was Joseph Morgan. Rt. 8, Fayetteville, who was given a 30-day sentence suspended upon payment of restitution for S55.30 to A & P. Joe Harris, no address listed, pleaded guilty to worthless check for S27.08 to Parks Grocery and a 30-day sentence was suspended upon restitution.
