THURSDAY, MAY 22,1975 In District Court Man Bound Over On Rape, Burglary Charges An unemployed seventeen year - old Raeford man was bound over on rape and burglary charges following a preliminary hearing before Judge Joseph E. Dupree Friday. Jerry Shaw, Rt. 3, will face indictment by the grand jury for the April 20 rape of Estelle Rogers, 62, a next door neighbor of Shaw's. Shaw was also bound over for grand jury action on first degree burglary in connection with the alleged assault occurring at the woman's home. Dupree ordered Shaw held without privilege of bond. In other action, two area men will also face indictment on felony charges by the Superior Court grand jury. Bobby Lee Edwards, Greene Street, waived a preliminary hearing on a charge of assault with a deadly weapon with intent to kill (ADWITK) and bond was set at $1,000. John J. Leach, Raeford, was bound over on a charge of ADWITK following a preliminary hearing and $200 bond was continued. Ei{ht drivers pleaded guilty to driving under the influence (DUI) and were sentenced. They were: Ray Steadman,418 Donaldson Ave., also pleading guilty to transporting open bottle in passenger area, six months suspended for two years, placed on probation two years, ordered to surrender license for two years, fined $150 and costs. A second guilty plea to another DUI charge resulted in an identical sentence to run consecutively and a $100 fine. Breathalyzer tests were refused in both arrests, according to records. Benjamin Lee Powell, Rt. 1, Raeford, was sentenced to 90 days suspended for 12 months, ordered not to drive for one year except under terms of limited permit, directed to undergo alcoholic's rehabilitation, and fined $125 and costs. Breathalyzer result was .12, according to records. Fred D. McCormick, Jr., Rt. 3, Red Springs, also pleading guilty to speeding 68 in a 55 mph zone in addition to DUI, 90 days suspended for 12 months, no driving for 12 months, except under terms of limited permit issued, $150 fine and costs. Breathalyzer result was .22, according to records. Albert Lawrence, P.O. Box 745, 90 days suspended for 12 months, no driving for one year except under terms of limited permit issued, $150 fine and costs. Breathalyzer result was .17, according to records. Charles Allen Jones, Ft. Bragg, 90 days suspended for one year, no driving for one year, $150 fine and costs. Breathalyzer rdsult was .17, according to records. Lonnie Eugene Hinson, Fayetteville, (also pleading guilty to two counts of misdemeanor hit and run and a charge of malicious damage to personal property in addition to DUI), two year term suspended for two years, two year probation ordered, no driving for one year, restitution payments of $230, $115, and $209.77 ordered, alcoholic's rehabilitation ordered, and $250 fine and costs. Breathalyzer result was .20, according to records. Edward Grace, Rt. 2, Raeford, pleading guilty to DUI second offense, six months suspended for two years. Gas Company Sets Dividends Regular 23c per share quarterly dividends for June and September were declared by the Board of Directors of North Carolina Natural Gas Corporation. Announcement of the board action was made by company president Frank Barragan. Jr. following the directors meeting. The first of the 23c per share dividends will be paid on June 16 , to stockholders of record June 2. The second will be paid on Sept. 15, to stockholders of record Sept. 2. two year probation, no driving for two yean, alcoholic's rehabilitation, and $250 fine and costs. Pleading guilty to DU1 third offense was Louis Paul Darden, Fayetteville, who received two yean suspended for 3V4 years, 314 year probation, no driving until licensed, alcoholic's rehabilitation, and $500 fine and costs. Breathalyzer result was .32, according to records. Marshall H. Johns, Camp Lejeupe, pleaded not guilty but was found guilty of allowing unlicensed person to drive in addition to DU1, and he was sentenced to 90 days suspended for 12 months, no driving for 12 months except under terms of limited permit, and $160 Tine and costs. Breathalyzer result was .14, according to records. A DUI charge against James H. Brock, Rt. 2, Raeford was dropped and Brock pleaded guilty to reckless driving and drew sixty days suspended, $100 fine and costs. Breathalyzer result was .14, according to records. Johnny Baker, RFD, Raeford, was found not guilty of charges of misdemeanor receiving stolen goods and assault by pointing a gun. Raymond Wallace, 32, Rt. 3, was found not guilty of assault. Raymond Wallace, 22, of Rt. 3, Box 241-A, pleaded guilty to worthless check for $ 11 to Larry's Drive-in and a second worthless check for $10 to Larry's Drive-in. Wallace received 30 days suspended on each charge and orders to make restitution and costs. Walter Parks, Main Street, pleaded not guilty but was found guilty of assault by pointing a gun related to a dispute over a cut - off of water service. Parks drew a 90 day term, suspended for two years, $50 fine and costs, and orders not to assault Willie P. Malloy for a period of two years. Parks gave notice of appeal and was recognized for his appearance. Lonnie Smith, Rt. 2, Raeford, was found not guilty of trespass and contributing to the delinquency of a minor. Carl Peavy, alias Sambo, was found not guilty of two charges of assault by pointing a gun and the prosecuting witness in each case was ordered to pay costs. Eugene Pate, Rt. 1, Red Springs, was found not guilty of ADW and the prosecuting witness was taxed costs. Reginald L. McRae, Rt. 1, Raeford, pleaded guilty to possessing a deadly weapon on campus and drew a six month term suspended for two years, probation for two years, and $25 fine and costs. Jimmy Lee McRae, Rt. 3, Raeford, pleaded guilty to assault by pointing a gun and injury to personal property and drew a six month suspended sentence and two year probation period in each case, to run consecutively. McRae was ordered to make $45.52 restitution, along with costs. A third guilty plea to' simple assault was consolidated in the judgment. Val M. Trask, Jr., 511 South Main Street, pleaded guilty to worthless check for $12.80 to Dial Grocery and was given 30 days suspended, and orders to make restitution and court costs. Joseph Lee McNatt, Clay Hill section, pleaded no contest to non-support and drew a six month term suspended for three years and orders to make $15 weekly payments for support. Costs were remitted for good cause shown. Archie McLean, Rt. 3, Raeford, was found not guilty of assault. Willie Locklear and Jesse McClure both Sandhills Youth Center inmates, pleaded guilty to misdemeanor escape and each had a 90 day term tacked on to their present sentences. Neil J. Gilchrist, Raeford, was found guilty of trespass following trial and was handed a 90 day jail term. Mack Coxe, 415 Sixth Ave., pleaded guilty to non-support and the result was a 60 day term suspended fpr three years and orders to make $20 weekly support payments. Costs were remitted. Daniel Locklear, Red Springs, pleaded guilty to worthless check for $ 100 to 211 Zip Mart and drew a suspended 60 day term and ordered to make the remainder of restitution unpaid, S2S. William Henley, Old Trad Mobile Home Park, pleaded guilty to injury to personal ? property and drew a PJC for two years and orders to pay costs. Theresa D. Griffin, Lumber Bridge, pleaded guilty to ADW and drew a PJC for two years and was taxed costs. A large number of defendants were sentenced on various driving charges. Leroy Washington, Rt. 1, Red Springs, was found guilty of driving while license revoked and he was handed a one year jail term. Wadtington gave notice of appeal and bond was set at $750. James R. Threatt, Rockingham, was found not guilty of driving with an expired inspection. A number of defendants pleaded guilty. They were Kenneth Avon Wilson. Rt. 1. Raeford. careless and reckless driving, 60 days suspended, $35 fine and costs; Roy G. Sowers, Jr., Sanford, speeding 49 in a 35 mph zone, prayer for judgment continued (PJC) two years, fined costs; Jacqueline B. Smith, Laurinburg, illegal passing, $10, costs; Lee W. Oxendine, Jr., Red Springs, having no operator's license, 30 days suspended, $25 fine, costs; David L. Osnoe, Fayetteville, 78 in a 55 mph zone, $25, costs. Also Donald O. Mortimer, Jacksonville, ni., 77 in a 55 mph zone, 30 days suspended, $25, costs; McKinley A. McLean, Rt. 1, Raeford, driving while license revoked, 12 months suspended, two year probation, no driving until licensed, $200 fine and costs; John W. Mcintosh, Rt. 1, Raeford, no registration, no financial responsibility, and having no license, 60 days suspended for two years, $50 fine, costs; Oliver V. Lockamy, Stedman, exceeding a safe speed, 30 days suspended, $50 fine, (68 in a 55 mph zone and illeeal oassine not oroserntedV Joseph Jones, Lumberton, driving while license suspended, 18 months, 3V4 years probation, no driving until licensed, $300 fine and costs. Also Bennie E. Holland, Shannon, 50 in a 35 mph zone, $10 fine, costs; Sidney B. Harris, Rt. 3, Raeford, careless and reckless, 30 days suspended, $25 fme and costs; Wilbur H. Faircloth, Fayetteville, SS in a 45 mph zone, PJC upon payment of costs; Eva B. Davis, 405 East Prospect Ave., 60in a45 mph zone, SIS and costs;and John D. Bentley, Fayetteville, exceeding a safe speed, fined costs, (65 in a SS mph zone, not prosecuted). A number of cases were not prosecuted. They were: Linwood T. Passwater, Jr., Ft. Bragg, having no operator's license; Mallie C. Graham, RFD Raeford, trespass; Coston Stephens, Bowmore section, ADW; Lonnie Eugene Hinson, assault, hit and run, forcible treapass; George F. Mayor. Rt. 1, Raefoid, equipment violation; Robert L. Doby, Main Street, worthless check; William A. Martin, McCain Prison, crime against nature (nol prossed with leave); Charles E. Dejoumette, Ft. Bragg, DUl; Claude B. Jones, 218 Lamont Street, speed competition; Dair Kodtak, Rt. 1, Cameron, receiving stolen goods; William Gildow, Rt. 1, Raeford, trespass; Karen Gildow, Rt. 1, Raeford, trespass; Hubert Bell, Red Springs, worthless check.
