Traffic Laws Clarified
For Bikes With Motors
Apparently there has been much
confuaon concerning the motor
vehicle laws pertaining to bicycles with
helper motors, according to Sgt.
Robert M. Walsh, traffic safety
information officer for the Highway
Patrol.
Listed below is the motor vehicle
law, G.S. 20-50.1, which reads as
follows:
"Notwithstanding any of the
provisions of Chapter 20 of the North
Carolina General Statutes, all pedal
bicycles with helper motors rated at
one brake horsepower or less and
incapable of exceeding 20 miles per
hour shall be exempt from all title and
registration requirements of Chapter
20, provided such bicycles so equipped
shall not be operated upon any
highway or public vehicular area of
this State by any person under the age
of sixteen (16) years."
One effect of this statute is to
define these types of vehicles as
bicycles rather than motorcycles,
thereby exempting them, in most
cases, from liability insurance
requirements applicable to motor
vehicles.; In addition, operators and
passengers would not be required to
wear safety helmets.
All pedal bicycles with helper
motors are exempted from all title
registration requirements; therefore,
would not be required to display a
current approved inspection certificate
under G.S. 20-183.2.
There is no exception, however,
from the drivers license requirements
for the driver of a bicycle with a
helper motor, Walsh said.
It is the opinion of the State
Highway Patrol, as well as that of
William W. Melvin, Assistant Attorney
General and the Drivers License
Division, that the driver of pedal
bicycles with helper motors must be
licensed as an operator or a chauffeur
by the Department of Motor Vehicles
if these vehicles are operated upon any
highway or public vehicular area of
this State.
All bicycles when used at night are
required by G.S. 20-129 (E) to be
equipped with a lighted lamp on the
front thereof, visible under normal
atmospheric conditions from a
distance of at least three (3) hundred
feet in front of such bicycle,and shall
also be equipped with a reflex mirror
or lamp on the rear, exhibiting a red
light visible under like conditions from
a distance of at least two (2) hundred
feet to the rear of such bicycle.
Since there is little doubt that a
bicycle with a helper motor is a motor
vehicle, G.S. 20-160(B) would also
apply, "No person shall drive any
motor vehicle upon a sidewalk or
sidewalk area except upon a
permanent or temporary driveway."
Bicycles are defined as vehicles
under G.S. 20-4 (49) and every rider
of a bicycle upon a highway diall be
subject to the provisions applicable to
the driver of a vehicle except those
which by their nature can have no
application. Therefore driving on the
right half of the highway, stopping at
stop signs, and traffic lights, improper
passing, etc., would apply to bicycle
riders.

$38,215 requested, due to expectance
of $10,000 in public employment
funds, listed elsewhere in the budget
and increasing over this year's

Library, $17,750, as requested,
increasing over this year's $15,750;
Soil conservation, $4,325, as
requested, remaining unchanged from

County development, $9,175, as
requested, rising from this year's

Lester said he felt certain the
troposed budget will be cut before it

"It will have to be trimmed to get
he tax rate down," he commented,

The tax rate adopted last year was
80 cents, but Lester refused to
peculate how the new rate will be to

In addition to the general county

ire districts. The levies have not been

Lester hinted some departments

The public budget hearing is set for
une 9 at 7:30 p.m. in the county

?Glusman said.
"No," Autry answered.
Glusman later asked, "In your entire history as principal there has
a student ever come to school with an obscene pictorial marking?"
Never, Autry agreed. Responding to questions, he said he had seen
shirts with obscenities on them, but said he did not consider them to
be common in the county.
Turning to the haircut policies, Glusman asked why a similar
regulation was not in effect for female students.
"Well, it used to be you could tell the difference," Autry said.
"I've never given it a thought."
Discipline was the heart of the dress code, Autry testified. "It was
a way to teach young men to accept authority," he said.
"Would you agree that there are plenty of other ways to teach
respect for authority rather than regulating hair," Glusman asked.
"Yes."
"Do you agree that you and your faculty are equal to the
challenge?" Glusman said.
Autry agreed.
Taking the stand, Edwards gave a different definition of pictorial
marking.
"It is a word or picture that is vulgar," he said.
"Why didn't you put that in your dress code," Glusman asked.
"I guess because hindsight is greater than foresight," Edwards said.
Edwards told the court that the dress code was enforced by two
teachers personally checking 22 classes, each, during third period
'every Monday, Wednesday and Friday.
"What else do you do every Monday, Wednesday and Friday?",
Judge Bailey asked.
Edwards said the check took about 45 minutes.
? "Wouldn't it be better to teach English during those 45 minutes,"
Bailey said.
"We do that too," Edwards answered.
