In District Court Church Becomes Hall Of Justice Judge Joseph Dupree opened District Court last week with an f admonition to the court room that taking an oath on the Bible was somehow more sacred considering that it was being administered on this occasion in a church. Court convened both Thursday and Fri day in the basement of the Metho dist Church due to the continuance of Superior Court next door. During Friday's session three men pleaded guilty to charges of misdemeanor breaking and enter ing and misdemeanor larceny. Thomas W. Smith, Ft. Bragg, Richard Dale Cox, Rt. 4, Old Trail Mobile Home Park, and David Allen Kaczmarski, also of Ft. Bragg, were all found guilty of breaking into a dwelling house trailer at the Old Trail Mobile Home Park and stealing a coil and compressor from a refrigerator valued at less than $200. Each man was sentenced to two years in jail for the breaking and entering charge, and each received a two year term for the larceny charge, to begin at the expiration of the previous term. The three four-year sentences were then suspended on ? the conditions that each man not be convicted of shoplifting, larceny, receiving stolen property, fraud, embezzlement or passing worthless checks for a period of five years. Each man was ordered to pay into the clerk's office $65 restitu tion for the prosecuting witness and fined $200 plus court costs. James Tillman Long, 422 Green St., pleaded guilty Friday to charg es of driving while his license was revoked and to assault on a female. He pleaded not guilty to driving while under the influence of intoxi cating liquors. He was found guilty of the DWLR charge and the assault charge. Judge Dupree found him not guilty of DUI. The court then recommended that Long be sentenced to 12 months in jail so that the Department of Correction could treat him for a confirmed alcoholic condition. Robert Billinger, Rt. 4, Raeford, was given a prayer for judgment continued after he pleaded guilty to assaulting Ernestine Watkms. Bil linger was charged costs of action. Margaret Smith, Rt. 1, Raeford, 4 was found not guilty of assault with a deadly weapon. Roy D. Hayward, Rt. 4, Box 248, Raeford, was found not guilty of t assault against Kathy Winborne. The prosecuting witness was or dered to pay court costs for frivolous and malicious prosecu tion. Leverne Blue. Rt. 2. Raeford, pleaded guilty of a non-support charge and granted a prayer for judgment continued for five years with the court reserving the right to pass final judgment within five years. For good cause shown costs of court were remitted. Oscar Carter, Sanford, appeared before Judge Dupree Friday for failure to comply with an earlier court order entered on a child support charge. The court found as fact that the defendant failed to comply without just cause and ordered Carter to begin serving a 60 day jail term. Floyd Ellard, Sandhills Youth Center, and Thomas Hewitt, also from Sandhills, both pleaded guilty to escape and were each sentenced to 90 days to begin at the expiration of the sentence currently being served. Jimmy Fiedler, Sandhills Youth Center, received a six month jail term to begin at the expiration of the sentence he is now serving after he pleaded guilty to a charge of escape. Terry Vaughn Oxendine, Fay etteville, was sentenced to six months, suspended, after he plead ed guilty to possession of a con trolled substance. Oxendine was fined $150 plus costs and ordered not to violate any narcotic control law of the state for a period of two years. Danny Ray Hayward, Rt. 2, Box 164, Raeford, pleaded guilty to a charge of manufacturing a con trolled substance and was placed on probation for two years after the court decided to delay passing a verdict. Hayward was fined $250 plus costs of action. Robert Jordan Calhoun, 831 E. Donaldson Ave., Raeford, was found not guilty of a stop sign violation. Shirley Ann Locklear, Rt. 1, Box 206, Shannon, pleaded guilty to exceeding a safe speed and was fined $25 plus costs. William Burton Cunningham, Jr., Fayetteville, was sentenced to 60 days in jail, suspended, and fined $50 plus costs after he pleaded guilty to a charge of careless and reckless driving. James Edward Hayes, Vass, was given a 30 day suspended sentence and fined $40 after he pleaded guilty to speeding 83 in a 55 m.p.h. zone. Gary Roy Kyhn, Ft. Bragg, pleaded guilty to displaying a vehicle number registration plate other than the one issued, and to having no financial responsibility and no registration. Kyhn was sentenced to 90 days in jail, suspended for two years on the condition that he pay a $50 fine plus court costs. He was cautioned to violate no motor vehicle laws of the state for two years. Lucions Locklear, Maxton, pleaded guilty to public intoxica tion and not guilty to a charge of carrying a concealed weapon, he was found guilty of both charges and sentenced to six months in jail, suspended for three years. Locklear was fined $150 plus costs and cautioned not to carry any deadly weapon concealed for a period of three years. Locklear's gun was ordered confiscated and will be disposed of according to law. Talmadge Hubert Briston, Wa gram, pleaded not guilty to an improper equipment violation. He was found guilty and ordered to pay court costs. The following cases were given voluntary dismissals: James Brice Roseborough, Fayetteville, failure to stop for a stop sign; William Edward Clark, Fayetteville, DUI; Blanche Readdy, Rt. 1, Bo* 541, Raeford, assault; James Earl Jack son, Red Springs, common law robbery. Thursday Session A charge of worthless check against James Walter McRae, Rt. 1, Box 844, Raeford, was dismissed by the state. William L. Sandy, Rt. 2, Box 121 -A, Raeford, pleaded guilty to non - support and received a 60 day jail term suspended for five years on condition he make $30 support payments every two weeks with first payment ordered May 24. All growers are urged to attend as a large turnout of growers would certainly be an indication to Secretary Bergland of the interest and concern that each grower has in maintaining and strengthening the tobacco program. A compli mentary barbeque lunch will be served. BEEF REFERENDUM UP DATE -? The tentative dates for the Beef Referendum have been set. Registration at the ASCS office will be held June 6 through June 17. Then, the dates for voting will be July 5 through IS. To vote in the referendum, cattle producers must first register at the ASCS office and certify that they * have owned cattle at tome time during the past (12) twelve months. Then, after a two- week waiting period, the producers should return J t to the ASCS office to vote. Absen I tee forms will be available, upon ?] request, for producers who prefer J to register and vote by mail. This referendum is being held for the purpose of allowing beef I producers to assess themselves in H order to promote and develop new markets for beef and for beef research. FARM-RETAIL SPREAD WI DENS ONE PERCENT ? The farm - retail spread -- the difference between the farm value and the retail cost of a market basket of food -- increased one percent from February to March. Increases in spreads were greatest for pork, dairy products, and frozen orange juice concentrate. In contrast, spreads for fresh vegetables and oilseed products decreased sharply while spreads for most other products changed relatively little in March. The farm ? retail spread in March averaged 4.5 percent above the level of a year earlier. Johnny Ray Suggs, Rt. 1. Box 320, pleaded guilty to speeding 60 in a 45 m.p.h. zone and driving while license revoked. He was given a two year jail term suspended for three and one half years on condition he pay a $300 fine and costs and not drive until properly licensed. Sharon Denise Torres, Rt. 1. Box 172-E, Raeford, had a charge of failing to possess a valid registration dismissed by the state. Bessie Morris Lee, Rt. 1, Dundee Farms, Raeford, pleaded guilty to an inspection violation and drew a ten day jail term suspended upon payment of court costs. A charge of improper passing against Nelson Tyler, Rt. 1, Box 190, Raeford, was dismissed by the state. A charge of failing to appear against Alphonso Pickett, Rt. 1, Box 794, Raeford, was dismissed by the state. A show cause order for contempt against Jack W. McMillan, Rt. 3, Box 74, Raeford, was dismissed by the state. A charge of non - support of illegitimate child against James Edward Locklear, Rt. 3, Box 212, Maxton, was dismissed by the state. A charge of assault against Horace Jacobs, Rt. 1, Red Springs, was dismissed by the state. Charges of failure to register vehicle and having no financial responsibility against Raymond Mitchell McRae, Fayetteville, were dismissed by the state. A charge of having no operator's license against Terrence James O'Connor, CSC 3/325 Ft Bragg, was dismissed by the state. Jessie Albert Burrow, Rt; 1. Aberdeen, pleaded guilty dnJ?J under the influence (DUD third offense and received a two year term suspended for three and one half years and was placed on probation for three and one halt years. He was ordered to surrender his license, not operate a vehicle for three years, undergo acholics rehabilitation and pay a $500 tine and costs. For good cause shown, $200 of the fine was ordered re Daniel Junior McNeil, Rt. 3, Box 166, Raeford. pleaded guilty to having no operator s license, making an unsafe movement, having no vehicle registration and no financial responsibility. He drew a six month jail term suspended for two years on condition he pay a $100 fine and costs and not violate any motor vehicle laws of the state that carry a maximum penalty ot more than 60 days for a period of two years. The cases were con solidated for judgment. Archie Melvin, Rt. 3, Box 288, Raeford, pleaded guilty to having no operator's license and a charge of DUI. He was given a six month term suspended for three and one half years, placed on probation for three and one half years and fined $300 and costs. Southern Pines, pleaded not guilty but was found guilty of an equipment violation and was given a 30 day term suspended upon payment of $25 fine and costs. C.E. Carter. Rt. 4, Red Springs, pleaded guilty to a worthless check charge in the amount of $600 to Ben Faulk and was given a six month term suspended upon pay ment of restitution and costs. Lee David Currie, Fayetteville. pleaded guilty to speeding 67 in a 55 m.p.h. zone and drew a 30 day term suspended upon payment of $5 fine and costs. Robert Earl Ruey. Fayetteville, pleaded guilty to DUI and received a 90 day term suspended for 12 months. He was ordered to sur render his license and pay a fine of $150 and costs. Box 247, Raeford, pleaded guilty to DUI and was given a 90 day term suspended for 12 months.- He was ordered to surrender his license and pay a fine of $50 and costs. Shannon, pleaded guilty of a reduced charge of speeding 70 in a 55 m.p.h. zone after being charged with 74 in a 55 m.p.h. zone and drew a 30 day term suspended upon payment of $20 ftne and costs. Robert Wayne Lowe. Maxton. pleaded guilty to a reduced charge of exceeding a safe speed after the state dismissed a charge of careless and reckless driving. He was fined S10 and costs.
