GIFT PRESENTED -- Teachers in the Hoke County school system gave Superintendent Raz Autry [right] a Christmas gift Monday afternoon at the Hoke County Board of Education building. Danford Dial, representing the teachers, presented the gift. 1- TKACHER (Continued from Page 1 ) COUNTY BOARD OF EDUCA TION (hereafter Board) by and ^ through its chairman, R.L. Gib son. WHEREAS, the Teacher is a career educator within the meaning of the North Carolina Tenure Act, N.C. Gen. Stat. 115 - 142 (1975), and has served the children and citizens of Hoke County as an educator for 15 years and, during that time, has rendered satisfactory and valuable services to th children of Hoke County; and WHEREAS, the Superintendent is now serving as the Chief Administrative Officer of the Board and, in such capacity, has primary responsibility for the administra tion of the county schools and particularly in matters dealing with personnel administration; and WHEREAS, the Board is the duly elected body charged by law for the overall operation of the county's school system; and WHEREAS, on 19 October 1977, the Teacher was involved in an incident, off school grounds, in ' which it was alleged that she had consumed an excessive amount of .alcohol; and WHEREAS, the Board and Superintendent, acting in good faith and in the interest of the children of Hoke County, took steps pursuant to the Tenure Act to inquire into the matter and to take such action as might be necessary and appropriate in order to protect the well - being of the county's children; and WHEREAS, the Teacher has. and does hereby, express, her appreciation for the concern of the Superintendent and the Board that county educators should not appear in any public place under the influence of intoxicants and further acknowledges that appearances on school grounds after having con sumed intoxicants in absolutely forbidden; and WHEREAS, during 15 years of service, there have been no similar charges and similar incidents to mar the record of the Teacher; and WHEREAS, the Superintendent and Board, while firmly main taining and reiterating the policy set out above, do not desire that a single incident such as described should, on the facts of this par ?, ticular case, result in outright dismissal provided that reasonable assurances are received to satisfy their concern on behalf of the county's children that no similar situation involving the Teacher * shall occur. NOW. THEREFORE. BE IT RESOLVED. UNDERSTOOD. AND AGREED THAT: 1. It is the policy of the Board that no educator employed by the Board shall appear on school grounds after having consumed intoxicants and should not appear in public under the influence of intoxicants; 2. That the Teacher shall be retained in her present position and the prior administrative action shall be withdrawn; 3. That the Teacher is hereby removed from tenure as it is defined in Chapter 1 15 of the North Carolina General Statutes and is placed on probation. That this probationary period shall continue until the end of the 1978 ? 79 school year. 4. That notwithstanding the provisions for dismissal as outlined in the Tenure Act. the Teacher may be immediately terminated for a * violation of the policy heretofore noted. Subject to the terms and con Hitions above, all matters and controversies between the parties hereto are by this Memorandum and Agreement amicably resolved ?nd the parties, by their signatures affixed below, voluntarily and understanding^ agree to the terms ?nd conditions set out above. Crime Control Agency Created Crime and public safety have become great problems in every state in recent years. Various methods of dealing with these problems have been tried, with little success so far. Reorganization of government agencies is one device popular with "reform move ments. North Carolina's legislature adopted a new statute in March 1977, in an attempt to help to deal with the matters. It sought to establish a more effective machine ry for the purpose, by creating a new "Department of Crime Control and Public Safety." Chapter 70. House Bill 1 19, 1977 Session Laws, enacting a new Article 5A to Chapter I43B (Section 143B-256 etc.), plus new Sections 127A-17, 20-185. I8A-15, 165-11.1. 17A-3. 17B-3, etc. - all effective April 1, 1977. The purpose of the new Depart ment is to provide law enforcement and emergency services to protect the public against crime and against natural and man-made disasters, and to coordinate efforts of various state agencies for these purposes. Functions of various existing departments are transferred to the new agency. The National Guard, Civil Preparedness. Civil Air Pa trol, Highway Patrol, Alcoholic Control Enforcement Division. Governor's Crime Commission, Crime Control Division, Criminal Justice Information System (and Security and Privacy) Boards, all now have their powers and func tions vested in the Dept. of C.C. and P.S.. plus such other functions as may be assigned by the governor. A Secretary of the D.C.C.P.S. is to head the new agency. Provision of a central coordinat ing headquarters may result in less fragmentation of efforts, less dupli cation. less staff and expense, and more effective results for the citizens" hard earned tax dollars. We hope so. We hope that the historic tendency of government agencies to multiply their empires and expenses will not occur in this one. We hope that the historic tendency of government agents and agencies to "solve" problems by forming "new committees" will not occur here. We hope. We hope. Various changes in the various agencies also are ordained by the new statute, in order to achieve its stated purposes. These changes are lengthy and detailed. Transfer of functions is ordered to be com pleted by July 1 . 1977. As one who has lived long enough to see and hear many big proposals, by many "public ser vants." for solution of many "pub lic problems," I am a bit cynical about the actual results of such "reforms" as this one. High pur pose words are many, but truly public-spirited deeds not so many, from what the years have happened to show to me. But we must continue to hope, and to try. So. let us hope for good results. Key was driving left of center when his car hit the abutment. He reported to the officer that he was having trouble with a tire. Key was charged with driving left of center. The State Department of Trans portion was notified and will determine the amount of damage to the bridge. According to Highway Patrol reports, a two ? car collision occurred Dec. 12 at approximately 6:15 a.m. on 'rural paved road 1003. Charlie Artis, Rt. 1, Lumber Bridge, backed out of his driveway in his 1967 Chevrolet and struck a vehicle operated by Lula Douglas Baldwin, also of Rt. 1, Lumber Bridge. Damages were estimated at S400 to the Baldwin car and SI 00 to the Artis vehicle. There were no injuries. Artis was charged with unsafe movement. On Dec. 10 at approximately 8 p.m., a t wo - car collision occurred at the intersection of Rockfish Road and rural paved road 1406. Archie Chalmers Davis, Rt. 1, Lumber Bridge, pulled out into the intersection and struck a 1964 Dodge driven by David Gallespie of Rt. 2, Raeford. There were no injuries and damage was estimated at $100 to the Gallespie vehicle, according to the Highway Patrol. Davis was charged with driving under the influence, failing to yield right of way and leaving the scene of an accident. Damage to his car was estimated at S7SO. COUNTY (Continued from Page 1) increase the daily pay of the three - member jury commission from S25 to $30. The jury commission is charged with making up the jury lists for the county. Balfour said the three members each worked 54 hours carrying out this duty. The board took under con sideration three recommendations by insurance representative J. A. Alston concerning the county's fire and liability coverage. It was discovered last month that the county had overlapping policies. Alston suggested that the county buy its insurance through one company to prevent confusion in the event of a claim. The board took no action on the proposals Monday night. Director of Social Services Ben Niblock appeared before the board to discuss the county's personnel policy. It was brought out that two county employees, one of them in the Department of Social Services, had been promised 15 days va cation by their department heads when they were hired for their positions. Normally, a county employee will get only 5 days vacation after the first year of employment, Balfour said. But, considering the circumstances in volved, the board voted to let the two employees have the time that had been promised them. The board went into executive session to review application for the position of county manager and accounting clerk. The board met again Tuesday to review the appli cations. According to Balfour 12 applications for the positions were received by the Dec. 15 deadline.
