Judge Dupree Declares Search Warrant Invalid
Two Raeford men, charged with
10 separate counts of drug violation
were released following a probable
cause hearing Friday because of an
invalid search warrant.
Danny Ray Hayward, 18, and
Gary Edward Walden, alias Gary
E. Pickett, 22, both of Lot 10
Pilgrim Trailer Park, Raeford,
appeared before Judge Joseph E.
Dupree in the probable cause
hearing in Friday's session of
District Court.

Although evidence was declared
invalid by Judge Dupree after a
deputy testified to information that
was not contained in the body of
the search warrant, Hoke Sheriff
Dave Barrington said. Barrington
said the search warrant was drawn
and held for four days before the
search was made because an in
formant told the sheriffs depart
ment that more drugs would be
found at the residence on the
weekend. The informant told
deputies where to find the drugs,
and, Barrington said, this infor
mation was not contained in the
body of the search warrant.
Grady White, Rt. 2 Box 4%,
Raeford, pleaded guilty to a charge
of peeping secretly into a room
occupied by a female person. He
was sentenced to seven months.

The defendant gave notice of

assault and four counts of assault
by pointing a gun. In each case, the
prosecuting witness was ordered to
pay costs for frivolous and
malicious prosecution.
Issac Douglas, Marston, pleaded
guilty to a charge of non - support.
Prayer for judgment was continued
for five years with the court
reserving the right to pass final
judgment within five years. For
good cause shown, cost was
remitted.
Stewart Mitchell Smith. P.O.
Box 621, Raeford, pleaded guilty to
a charge of driving under the
influence (D.U.I.). Breathalyzer
reading was .22 percent. He was
sentenced to 90 days suspended for
12 months upon payment of a $150
fine and costs. He was ordered not
to drive for 12 months as set out in
the limited driving privilage order.
Johnnie Farrell Batton, Rt. 1
Box 629, Raeford, pleaded not
guilty to a charge of D.U.I.
Breathalyzer reading was .14
percent. He was found guilty of the
lesser charge of reckless driving
and was sentenced to 60 days,
suspended upon payment of a $150
fine and costs.
Williams Junior Perkins, Aber
deen. pleaded not guilty to a charge
of D.U.I. Breathalyzer reading was
.10 percent. He was found guilty of
the lesser offense of reckless driving
and was sentenced to 60 days.
Sentence was suspended upon
payment of a $100 fine and costs.
Willie McGilvary. Rt. 3 Box 203,
Raeford. pleaded guilty to a charge
of D.U.I, and driving left of center.
He was sentenced to 90 days,
suspended for 12 months upon
payment of a SI 50 fine and costs.

In Thursday's session, Rodney
Karl Lyle, Rt. 4 Box 312, Raeford,
pleaded guilty to a charge of
misdemeanor breaking and en
tering. He was sentenced to two
years as a committed youth of
fender and sentence was suspended
for three and one half years. He was
ordered to co-operate with his
probation officer, remain in the
state, violate no penal laws, remain
gainfully employed or in school and
pay costs of court.
Marvin Jones, McFadyen's
Trailer Park, Raeford, was sen
tenced to 60 days after he was
called and failed to appear on a
charge of non - support. The court
found as a fact that he is the father
of the child named in the action.
L. BryonCaton, Fayetteville. was
found not guilty of allowing live
stock to run at large.
Joe R. Hodges. 108 E. 6th Ave.,
Raeford, pleaded guilty to four
worthless check charges. He was
sentenced to 30 days in each case
and sentence was suspended upon
payment of $30.58 restitution to
Park's Grocery and he was ordered
to pay costs in each case.
William E. Willis, Willis Pro
duce Market, Raeford, pleaded
guilty to a charge of worthless
check. He was sentenced to 31 days
suspended upon payment of
$370.25 restitution to Dillon Seed
Co. and costs.
Geneva Powe McGregor. Ral
eigh. pleaded guilty to a charge of
D.U.I. Breathalyzer reading was
.22 percent. She was sentenced to
90 days, suspended for 12 months
provided she not drive for 12
months except as set out in the
limited driving permit and she was
ordered to pay a $150 fine and
costs.
Mack Leo Dockery, Rt. 1 Box
390. Raeford, pleaded guilty to
D.U.I., second offense. He was
sentenced to six months, suspended
for 12 months upon payment of a
$200 fine and costs. He was ordered
not to drive for 12 months.
Breathalyzer reading was .25
percent.
Howard Morris White, Red
Springs, pleaded guilty to a charge
of reckless driving. A charge of
D.U.I, was dismissed. Breathalyzer
reading was .14 percent. He was
ordered to pay a SI 25 fine and
costs. A sentence of 60 days was
suspended.
Gus Mclntyre, Jr., Fayetteville,
pleaded guilty to charges of driving
while license revoked and speeding
64 in a 55 m.p.h. zone. He was
sentenced to two years, and sen
tence was suspended and he was
placed on probation for two years.
He was ordered not to drive for two
years and to pay a $300 fine and
costs.
Robert Lewis Saltzman, Fay
etteville, pleaded guilty to speeding
73 in a 55 m.p.h. zone. He was
sentenced to 31 days, suspended
upon payment of a S20 fine and
costs.
Marshall Ray Patterson, Laurin
burg, pleaded not guilty to a charge
of D.U.I. , third offense. He refused
the Breathalyzer. He was found
guilty and sentenced to 18 months.
The defendant gave notice of
appeal.
Lester Miles Camp. Red Springs,
pleaded guilty to a charge of no
operator's license. He was sen
tenced to 31 days, suspended upon
payment of a S25 fine and costs.
Randy Larue Quick. Ft. Bragg,
leaded guilty to speeding 82 in a
5 m.p.h. zone and no operator's
license. He was sentenced to 60
days, suspended upon payment of a
S50 fine and costs.
Jack McGvigor. Rt. 1 Box 414,
Raeford, pleaded guilty to a charge
of no inspection sticker. He was
ordered to pay costs.
Bobby Lewis Green. Rt. 2 Box
501, Raeford, pleaded guilty to
driving without a license. He was
sentenced to 60 days, suspended
upon payment of a S75 fine and
costs.
Eldred Blue. P.O. Box 405,
Raeford, pleaded guilty to speeding
64 in a 55 m.p.h. zone. Prayer for
judgment was continued upon
payment of costs.
Phillip Franklin Durham.
Greensboro, pleaded guilty to
speeding 65 in a 55 m.p.h. zone.
