Expert Witnesses Paid More Although the ordinary witness fee allowed under North Carolina law is $5 per day, some witnesses may demand and receive a higher fee. Take for example the expert witness. He is not the ordinary witness who knows something about what happened in a par ticular trial; he is a witness because he has some expertise in a certain area that might help the court or jury understand what happened in the case. An expert witness, for example, might need to testify about con struction techniques in building a house, a high-rise apartment or a skyscraper. Law For Laypersons Another expert witness might testify about how a particular machine should operate and what might cause it to malfunction. Ex pert witnesses are also needed to testify about the value of a par ticular piece of land when a court is trying to determine what the owner should be paid when the state is condemning it for public purposes. When an expert witness testifies. North Carolina General Statutes section 7 A-3 1 5(b) does not limit his payment to $5 per day as is the case with the ordinary witness. The expert witness may receive such compensation and allowances as the court in its discretion may authorize. In a recent case, Stale v. Johnson, reported in Volume 282 of the North Carolina Reports at page 1 , the state of North Carolina had condemned certain property owned by Johnson. Four expert witnesses testified for the property owner about the value of the land. After the trial was over, the court in its discretion allowed a fee of $1600 for the testimony of the four expert witnesses. It taxed this cost against the state.
