The Raleigh correspondent of The Henderson Herald says: 'lt' turns out that there is direct conflict in sections two nnd four of Chapter 21S of the laws of ,18(10, enti tled "An net to amend the Constitu tion of North Carolina." This is the cha iter which provides for the sub inissio nof the proposed amendment to 1he people. Section two provides that the proposed amendment shall go into effect on July 1st, 11102. if a ma jority of the. qualified voters of the State so declare at the election in Au pnsl nest.'' Section four provides that it 'a majority of the votes east nre in favor of said proposed amendment, the lovernor shall certify the same to the Secretary of State. Section two of article 12 of the State provides that the constitution may be a mended if a majority of the votes cast are in favor of such proposed amendment. If ihe election should be held under the law as herein set out. a grave ques tion for the Supremo Court would at once arise. In this view Hon. II. (i. Connor. Speaker of the House of Kep resentntives, has written the members' thereof to he,. sure a ml be present at Ihe meeting of the General Assembly on I uestlay, the 1 : 1 1 1 of next month, for the purpose of striking' out the words "ipialiticd voters." and insert "votes cast." so as to make Section two of Chapter 318, read "if a majori ty of the votes of the State so declare at the election in August next." Trie Supreme Court has decided many times that 1hevofiU "(majified .vot ers" lueaiw i those .persons, whose names' are nn the registration .books. All Hiicb persons having1 been' found to pass the qualifications -required by the constitution as a prerequisite to registration and voters, their names are then transscribed on the registra tion bookx. and they are then "quali fied voters" in the sense of the consti tution as laid down by the Supreme Court. Therefore, if the promised -amendment must" be approved bv a majority of the "qualified voters" of the Slate, this number would be de termined by the total number of per sons whose names are on the registra tion books at the election in August next. The total number of voters in this State is ahoilt three hundred and seventy-five tlioiisuiicT If all of these voters should be registered one hun dred and eight v-eight thousand votes would be required to adopt the pro posed amendment.
