rumor here today tlmt the Legislature
may be called to meet in extra session.
J. 0. L. Harris and others hare urged
Governor Russell to call it.
The Governor was asked if he would
call it, and replied, "I have nothing to
say this afternoon,"
Members of the Council of State ray
that tbey have not been consulted about
the matter.
Harris says the session ought to be held
to consider tlio matter of tax rate, since
the Supreme court's adverse decision.

The State Treasurer today ls:ie 1 the
following important circular:
"Section 51, Revenue Art of 1807 pio-
vides that, ''Every person, firm, com
pany or corporation who aliall enpage in
the business of felling or offering for
sale by a drum nor nr drummers, with
or without sample, goods, wares or
merchandise of any description, in this
State, shall, before so selling or offering
for sale any such goxls, wares or mer
chandise, pay to the State Treasurer a
tix of fifty dollara (150,00), and ol.tiln a
license, which (hall operate ona year
from its date."
"It is evident that the General Assem
bly, by saying, "Every person, firm,
company or corporation; meant that this
tax should apply to all drummerj alike,
both foreign and resident. But as l he
Supreme Courts, both National and State
have decided that a State can not tax
foreign drummers, therefore this section
is inoperative and void as applied to
foreign drummers. It is further evident
that as the section was intended to apply
to all drummers alike, and cannot apply
to foreign drummers, it should not, and
cannot justly apply to- resident . drynv
itiers. It is, also, evident that the Lesis-
alurc intended to put this tax upon A
class. If their power fails as to a part of
the class, there is no reason to belive ii
a-as intended to be in force as to the rest,
it is not rational to ascribe to the Legis
latures purpose to impose a burden upon
a portion of that class resident within its
borders, and exempt that portion of the
same class who are now resident.
"I hold, therefore, that Section SI,
Revenue Act of 1396 Inasmuch as it can
