UALKioir, N. C. July 14. The council of State took no action as to calling the Supreme Court together to pass on the school law. It decided that it had no authority. The Governor says there is nothing he can do in the matter, that it is a matter for the county authorities, and they may be advised. State Superintendent Mebnne says the local tax campaign will be fought right through, and that Halifax and Craven people must hold elcctian or go to jail. The Governor and State Board of Equalization announce that they will go to the county officers convention at Morehead City. It is found that the bullet which killed Banks at the sham battle last night was an armory target bullet, small and round. Sugar reacted some what ou account of realizing on profits, and also on the report that Speaker Reed persists in the adoption of the Dinglcy schedule. Tohacco stocks strong on dividend. The Railway list is advancing on in creased earnings. Cotton was strong on the Weather bureau report of continued dry weather, Grain has a strong position, receipts being light and absorbed, and the foreign demand is good. Farmers arc holding back for better prices. The world's visible supply decreased three million bushels for the week. We Hunk that the farmers will receive belter prices than last year. C, July 14. f With bright and cheerful hearts last night the Governor's guard marched out to the park to have a moonlight drill, and sham battle. During the tiring, one target cartridge was fired, and with death bearing whirr entered tne brain Xif Jack Banks a private, in the opposing platoon. How the cartridge was ever overlooked in issuing "blanks" will never be known, and of course no man knows whose finger it was, that fired the gun, that killed a favorite comrade. The man only lived a few moments. The company marched back to their armory where the body was dressed and carried to bis home. Ho was about 31 years old, and married last October. Governor Russell was called back to Raleigh yesterday to get a decision from the Supreme Court as to the constitu tionality of the act passed by the last legislature regarding the election on the local tax for public schools. Several lawyers of prominence have expressed themselves in doubt as to whether the act was legal. A special sessiou of the Supreme Court will probably be culled today. One of the new laws require miners to make sworn reports to tho Labor Com missioner as to the amount of air pump ed iuto the mine. The Cumnock mines are the first to send in such a report. Before the railroad commission yester day there did not appear Judge Clark, Governor Russell or Josephus Daniels. Their papers before the commission had been read and replied to, and they were invited to come and reply to the argu ments against their views. There would have been some heavy firing had they appeared. Raleigh is said to be the best repre sented at the Chapel Hill summer school of all the places in the State. A laborer yesterday fell from the roof of a three story dwelling clear to the ground. He is badly injured but still alive. All the old messengers from the offices in the capitol have filially been removed. They were all Republicans, it is said that Jim Young wanted them removed so out they go to be succeeded by more Rc publicans. The new janitor of the Supreme court building Mr. J. F. Westmoreland from Davidson county, has just had an at tack of paralysis. The "sheriffs convention to be held at Morehead next month will be known as the "County officers convention."
