Legis lative Act of February Construed by Judge. Special to Journal. Raleigh, N, C. October 6. Judge Siinonton today filed decree here in th suit by private stockholoer William R. Tucker against Governer Russell, Attor ney General Walser, the Board of Public Improvement, and the President and State Directors of the Atlantic and North Carolina Railway. The Judge dismisses the complaint as to the Governor, Attorney General and Board Public Improvements, and dis solves temporarily the restraining order which he granted at Charleston so far as t enjoins the enforcement of the legisla tive act of February 23th, last, which re quired the Governor to sue for the poss ession of the road, and the Judge to ap point a receiver. Hut tho Judge makes the temporary restraining order permanent so far as it enjoins enforcement by tlu railway ompany of the act of last February to imenu tne ooarter, out the Uovernor is permitted to appoint a State proxy. Tne road is forbidden to attempt to enforce that part of the act of last Feb- uary repealing section 4 of tho charter and amendments, and that provision re quiring the State proxy's presence neces sary to constitute a quorum, unless at a meeting of all the stockholders held af terwards, until the act of last February lie unanimously adopted ty the niaior part of all present as a charter amend ment. The Governor, Attorney General and State Board of Improvements recover their costs of Tucker, and he recovers all his costs from the road. Prices Very Reasonable. Sheehan has written to Richard Croker declaring that intends to resign. He has told Mr. Croker that the poiition which he occu pies has become intolerable, that he can no longer endure to act as the leader of an organization in which he has no au thority. John G. Sheehan repeated today his declaration that Judge Van Wyck would not retire from the Democratic ticket, but four out of every Ave of his follows- ers who came to Tammany Hall this morning expressed the opinion that the ticket would have to be changed. One of them, a member of Congress, predicted that Henry George would poll 100,000 votes if Van Wyck could not be induced to leave tho Held. Others said thai even if George did not poll so many votes he would draw so heavily from Tammany as to endanger the success o( the Democratic city ticket. Henry George this afternoon talked freely about his campaign. Among other things he said: "I am not altogether for free silver or for the gold standard either. am more of a greenbacker than any- ling else. All the friends of Bryan are with me In this fight. Jerry Simpson and others have offered their services in the last few days. I believe iu returning to the doctrines of Thomas Jefferson. The Presi dent does not contemplate accepting any invitations between now and the time Congress assembles that will involve his absence from the city, and expects soon t turn bis a ttention to the annual mcs- lgc, which he hopes to have completed by Thanksgiving Day. The cabinet meeting today was largely devoted to the forthcoming annual reports of the sever al heads of departments, which serve as a guide to the President in making re commendations to Congress relating to the various ofllces. Secretary Long today issued orders for the transfer of the Yantic, now at the Boston navy yard, to the Michigan re serves, in charge of a crew of forty men, two naval officers and two officers of the state reserve, lhe vessel will be in con dition to make the sea journey to the St. Lawrence by October 15, and on entering the river will proceed slowly until Que bec is reached. At Quebec the reserves will take charge of the vessel and con duct her through the canal to Detroit. The White House has this week taken on its winter apparel. A deep green car pet, with gold colored harps, has dis placed the well-worn covering of years on the upper floors.and down stairs heavy curtains and hangings have taken the place of light summer effects.
