Sutton, Judge of the Criminal Court, sitting at Charlotte, who n few days ago instructed the sheriff to prepare a delinquent list of all parties not having paid their tuxes by the night of December 18th, and to furnish the same to the court, in order that the delinquents might be dealt with according to law, prac tically settles the question of whether the law for imprisonment for non payment of taxes will be en forced or not. Judge Sutton says the Sheriff bus no voico in the matter, but that the Soicitor must present the delin quents, and the law will be carrie 1 out as passed by the last State Assem bly. ,, i'opnlists and Republicans have often asserted that the tax law pass ed by the last Legislature did not provide for imprisonment for failure to pay taxes, but this order of Judge Sutton's knocks out all questions on t hat point. It has also been urged that this law was not constitutional, but what is the poor man to do, wl.o cannot pay his taxes, when brought before the court? He may claim anything he thinks of, declare what he wants, bnt in the absence of money to settle with the sheriff, he will be walked off to jail, perhaps to remain there while the Supreme conrt decides Whether bis imprisonment is constitutional or not. Another important thing to note in respect to this law is, that the sheriff is powerless in tho matter, and is simply an instrument to carry out the law upon all offenders who fail to pay their taxes. To the unfortunate poor man, who may have to go to jail for not paying his taxes, it can hardly be a matter of consolation, 'while waiting in his cell for the Supreme court to decide npon hi case, to try and remember whether he voted for a member of the last Legislature who voted for the law which placed him in jail. The law which imprisons for debt, and a debt which can be collected by the power of the State without the imprisonment of the citizen, Is an enactment against the personal liberty of the citizens of North Car olina, and the penalty is one inflict ed upon the unfortunate, being most truly a punishment upon those who may be unfortunate enough to belong to the poverty class.
