Ralbioh, November 2 Judge Simon-
ton's decision In the case of Virginia B.
Matthewstof New York, a stockholder
ot the Carolina Central Railroad against
the corporation commission, was secured
and filed with the clerk of the Circuit
court. This case was argued at Auheville
and involves the right of the : commis
sion to reducs the minimum in car load
shipments of fertilizers from IS to 10
tons. Judge Simonton holds that the
commission has right to fix reasonable
rates when the charter was granted since
18G8-rnotwlthstandlng there is provision
in the charter that that power shall rest
solely in the board ef directors. He fur
ther hulds that the act creating the Car
olina Central Railroad Is an amendment
to the charter of the corporation com
mission. , it is also neld that tlie road
was chartered In 1881. Judge Simonton
states that the unreasonableness of the
rate cannot be decided by affidavits with
any degree of satisfaction.: He therefore,
appoints K. 8. Martin of Wilmington, a
special master to Inquire Into the rates
prescribed and specially as to . their rea
sonableness, with leave to report in this
special matter. - ' . .
The most significant feature in Judge
Slmdnton's decision Is this sentence:
"No issue can be decided by affidavit
with any degree of satlsfaotlon." This
ieads.strongly to the bsllef that . Simon
