Matthewstof New York, a stockholder ot the Carolina Central Railroad against the corporation commission, was secured and filed with the clerk of the Circuit court. This case was argued at Auheville and involves the right of the : commis sion to reducs the minimum in car load shipments of fertilizers from IS to 10 tons. Judge Simonton holds that the commission has right to fix reasonable rates when the charter was granted since 18G8-rnotwlthstandlng there is provision in the charter that that power shall rest solely in the board ef directors.
