To tie " Justices of the Peace of CraYen County.'- , C entlemen: I find In Thareday morn leg's issue of the New Bern Dally Jour nal, a letter from J J Baxter, commls- tloner to the magistrates, Baying he had infom ion from the Register of Deeds that notice had been sent to the magls trates to meet at 10 a m, on Saturday, July 4, 1903, for the purpose of electing a commissioner to fill the place made vacant by the death of Commissioner E R Jones, and If the magistrates had re ceived such notice, It was sent without any authority of law, and by some one who was assuming to discharge duties which belong to the Board of County Commissioners, and If you vent to meet you could not elect acommisaioner be cause you were called. together without authority of law, and the request Is made that you do not obey the call which has been Issued, but wait until you receive the proper calL t ' ' , In reply to Mr Baxter's communica tion, I have to say he was aware-of the fact that I made the call for the meeting on July 4, 1903, and he well knows : that the Justices of the Teace of Craven oounty Is a body corporate and has the right to perfect . Its .own organization, and as they have seen fit to honor ma as their chairman, and If 1 have not the authority to call them , together, who hat?-M ( , , - " Bee. 718 'of, the Code .Vol. 1 says: There shall bo a meeting of the Jus tices of the Peace on the first Monday In June to elect Ooanty ' Cummlsslonert.'' Again See. 719 says: "In case of a va cancy occurring in the' Board of Com missioners of a oounty, the 'Justices of the Peace of the county shall appoint to said Office for the unexpired term," Why did Mr Baxter cjuote this section In sup port oLhis Srgumentt , ?
