Special to Journal' Raleigh, May 28th., p m. Judge Pnrnell appointed Thomas D Meares of Wilmington temporary receiver of the A & N O railway today. S O Ryan was made special master to take evidences. LATER. 9 pm. State mhde answer to Cuyler's com plaint which was not produced in court Judge said he had read and considered It. V E McBee former receiver, came In after proceedings began. Attorney Pou for State offered number affidavits. Ex-Judge Womack read affidavit) from Mrs Florence P Tucker of Raleigh, lar gest private stockholder, aho from Dempsey Wood. Private atockholter almost unanimously in favor of ase and were re dy to vole fojpbne, stating that the Governor had good proposition to lease Tbe Judge asked for m dlflctlon of order n I continuance of case for 60 or 90 daya, whei the stockholders could be called together lu a meeting and consid er lease propositions. They deemed the best way to preserve property and en bance tbe Interests of stockbol lore was by term lease and further said the issue was for liase and not receivership. Judge Pnrnell said there was only one question before court, advisability of ap pointing a receiver. Ue denied motion for continuance and modification. This decision put Womack's clients on the tide of defense. Petition from K S Flnoh was read ask Ing that he be made party plaintiff, say ing that proceeding before Chief Justice Clark wsre to obstruct this court In dis charge of its duty. Judge ordered, both sides agreeing, that Finch be made a party to the snlt. Ths defense entered exception, Judge Pnrnell ssid he was inclined to think there was enough allegatlo and admis sion in answer to justify ths appoint ment of receiver. This afternoon B C Beck with ol Board of Internal Improve ment filed report with the governor, which did not concur with investigat ing committee in some of the conclu sions. The answer says road has been well managed for the put fcur years under State control as any property under con irol oe Corporation In which State has no direction or voles that the road was never In so good condition as It la at present, Is admitted by both friends and foes of management. It is concluded that governor's jadgmant was not at fault, In retaining Pres Bryan that good and economical management has been sustained.
