Supreme Court which nays that owners of stock in a non resident corporation allow for tax upon such stork. Of course the cor poration pays a corporation tax in the State in which it is located. Auditor Dixon has been coll ecting taxes here on such shares, but has had a great deal of trouble and no little kicking about i', which thisdecision will put an end to. A number of students at the Medical Department of the State University, which is located at Raleigh, today has twenty-three students, which shows a very marked increase as compared with any previous nTirr.bjr, The Raleigh and Pamlico Sound Kail way will within sixty days open its first section to traffic, this being from Raleigh northeastward, about fifteen miles. Acting Labor Commissioner Bruner today received applications from per sons in r orgytn (Jo. tor tour uorman families. Judge Purnell of the Federal Court did not file his decision in the Police Justice case, regarding the power of the Raleigh police justice under a spec ial legislative act, until this afternoon, having given the subject much consider ation. The contention of the Attorney General is that this case is not in line with the Georgia case, in which there is no regular trial, while here there are always regular trials, with counsels and the right of appeal. A very important case has been ar- ued in the Supreme Court, this being Green against the Hartford Life In surance Company, involving greater interests than any case before this court in many years. The principal question is whether an assessment com pany haa the right under legislative authority to change its future business from assessment to old-time insurance Over twenty of the largest assessment companies, confronted by the other failure of assessment insurance have been permitted by the laws of ten States to make this change and hun dreds of millions of insurance have been issued in consequence of and relying upon the legality of the change. The courts, including the Supreme court of the U. S., have uniformly approved the change. If now a different rule shall be generally adopted the dissolution of an immense number of insurance con tracts will be the inevitable result. The case comes np upon complaint of Mr. Green of New Bern that the Hart ford Life Insurance Company which by its charter has always had authority to issue both assessment and legal reserve insurance, for the first few years of its distance did an old-time business, then did exclusively an assessment un til 1899. when it ceased this and re commenced the issue of old-time insur ance but has continued to carry out i contract with assessment members, holding their reserve intact for their sole benefit and protection. The change of business was caused by the failure of assessment insurance. Mr. Green wss an assessment member and claims that the company is bound to go on with that class of business and that by making the change the company baa broken its contract with him. Hs therefor demands he payment to him of all the assessments he has ever paid, with interest . Judge Allen noo-sulud the plaintiff in the lower court and he appealed. The plaintiff was 'repre sented in the Bupreme court by A. D. Ward and Charles L. Absrnethv and the company by Charles W. Hinsdale and W. W. .Clark. !. . . . The Judge denied the petition and remanded Bertha Brown, the ten derloin woman who was fined $100, and the three negroes who were sent to the roads for fighting and gambling, to the custody of the State, and to the city, to pay the fine and serve their terms. L: R. High, J. C. King and Jack Peele, three'of the four attendants at the Central Hospital here, in jail, charged with murdering Thomas Nail, a petition today secured writs of habeas corpus by associate justice Brown, re turnable next Monday morning on the Supreme Court room. This action was decided on by their attorneys as a result of evidence given by a number of physicians yesterday that Nail's death was due not to blows on the head, but to heart trouble brought on by excessive efforts in en deavoring to escape and struggling with the attendants. After all is said and done there can be no mistaking the rharacter of stage entertainment which vouchsafes the greater amount of pleasurable enjoy ment to the masses of theatre patrons. It is for amusement solely that the beet patronage is given to the playhouse. How well did the late Charles H. Hoyt understand and appreciate this colossal truth when with the aid of Willie Edou in he managed to evolve such a pro nounced hit ls a "Bunch of Keys" sig nalled some years ago when it may be said the whole world of amusement was suddenly and agreeably astounded by the introduction of a series of laughable incidents adroitly and ingeniously strung together and cleverly interspersed with popular musical gems, indeed, it was 'A Bunch of Keys" which set the pace for all latter day so-called comedy suc cesses, and even now it would be ex tremely difficult to point to anything ap preaching Its intent, which can compare with its remarkable vitality. It may be justly commented upon, that the real bone and sinew of this, Hoyt's first and most lasting success, is the kind of substance which has almost invariably escaped the attention of modern farce w iter.
