The Elkins amendment to the rate bill which pro vides that inter-state roads cannot en gage in the production of coal and othj er commodities passed the Senate today. The upper house has about finished the discussion of the bill and it is expected a vote will be taken soon. Senatoi Gorman, of Maryland, is critically ill at his home, suffering with a complication of diseases. The attend ing physician gives no promise of re covery, Congressman Houston, of Tennessee, presented a resolution in the house to day demanding an investigation of the Agricultural department. William Nelson Cromwell who is chief counsel for the Panam i railway defied the the request made by Senptor Gorman for demanding an explanation of the letter Cromwell wrote the late Secretary Hay and declared that Con gress has no power to remove direction of the company. Chief of the Bureau of Naval Con struction announces that a monster 20,- 000 ton battleship will be built for the navy if the makers be given four years to complete the work The only plate it can be made is at New York. The cost will exceed $10,000,000. Second Trial of Hancock iiWU Telegraph j From Government Fish Hatchery Planted Company Elide In Plaintiffs Favor. The jury in the case of Hancock vs the Western Union Telegraph Com pany which was on trial Tuesdiy gave a judgment to the plaintiff of $1,000. The time for deliberation was short. This is the second trial of the case, it having been remanded back for trial on error. The case is the result of an alleged miscarriage telegram and the first ver dict was for $2,500 for the plaintiff. The trial of the case of Uisosway vs Edwards began last evening. For Sale by F. S. Duffy. at dedication of M. E. Church South, Tuttle's Grove. Wire Orass, May 7. On the morning of the 29th of April. ISMXi, the talented consecrated Rev. D H. Tuttle, of Fayetteville, N. C, preached at the M. E. Church, Tuttles Grove, for the first time since the foun dation of the church. Long before the appointed hour the building was seated to the utmost capacity and many who Kuld not obtain seats ins'de were sat- ed upon buggies and carriage i at the windows and doors. At eleven he preached a fine intellectual frame work sermon. It was filled with earnest spirituality, after which the small amount necessary to clear the church of its indebtedness, was quickly and easily raised. At 1:30 luncheon was served on the grounds, after which friends and tic ijuaintance exchanged greetings with one another until 2:30 when the peale of music rendered by Miss Edyth Ken nedy of Newport, Drought every one in the church that could obtain seats. Then followed the dedicational sermon and exercise. The church was dedica ted to God in the name of M. E. Church Tuttles Grove. Rev. D. H. Tuttle with his enthusiastic voice again held the audience in perfect silence, his dis course was clear and forcible. Never was a larger gathering present at the dedication of a country church The aumber estimated were between 1,000 and 1,200. The public will be interested to read the synopsis of the delightful opera to be given tomorrow night, the Journal will give a brief synopsis: The first scene is on board of an ocean steamship, among the passengers are a crowd of jolly young women with Miss Hurrican (Mrs M L Hollowell) as chaperon. Gen. Knickerbocker (Joe Watson) of New York, a stern, sturc y dignified person is also a passenger with his daughter Violet, (Mrs Annie DeRossett Harriss of Wilmington) with her friend. Dolly (Mrs. Herbert Tis- dale. Gen. Knickerbocker is very desirous to have his daughter marry the ( cen tric English Lord Dolphin, (Clarence Crapon) who with his valet Lord Teddy, (Albert Willis,) is among the passen- gf r on the boat. The o'd general's will regarding Violet and the Lord are Bet and although she is in love with AlvinBarry (CTPumphrey) a Wall street broker, her wishes are not con sidered n the matter. Dolly and her other friends help her in her love af fairs with Barry. Barry resorts to a ruse to gain Vio lets hand in marriage and assumes the title of the Grand Tyioon under the name of H R H Sham of Japan, f'e sends word to Gen. Knickerbocker that he with his retinue of followers will pay the general a visit. The latter is highly pleased that he should be the object of so much honor as to have a member of the royal household of Japan as his guest and he makes elaborat preparations for his entertainment. The Grand Tyccon arrivesand after the formal salaams and introductions the Tycoon falls in love with Violet and the general is delighted at tha progress of the match. The Tycoon divest himself of his disguise and shows himself as Barry, whereupon the general acknow ledges that he has used superior diplo macy and congratulates him en the success ot nis deception ana bestows his daughter Violet cm him as his wife. In Neuee River. Mr. G. N. Ives received from the (Tovcrntnent fish hatchery at Edenton, a consignment of 704 000 young shad, for planting in the Neuse. It came on the steamer Albemarle and was receiv ed by Mr. Copelandthe distinguished agent, who at once put them in Mr. Ive's care. They were transported on the naptha launch Lucia to the narrows several miles aDove New Bern ana ae- posited in the river by Mr. Hellen Huff. Owinp te a delay in the Atlantic Coast Line train a few days ago a ship ment of fish marked for New Bern were carried on to Wilmington and planted there. The fish received here vesterday were originally meant for the Wilmington waters but the ship ments were exchanged. There has not been any shad plant ing tor two years ana it is Denevea that this consignment will stock the river with plenty of fine shad. It is hoped that a. second planting maybe secured before long Mr. Ives is to be heartily commended for his energy in getting this large supply of fish. Charlotte, May 9. - The committee on program for the four days celebration beginning May the 21st, has made its report. Monday, the first day, the program I will consist of an informal reception to I i all "Come-Homers." at the Manufac turers Club at mid-day. The ladies con stituting the Charlotte Womans Club will have charge of this reception. In the afternoon at 3 o'clock there will be a balloon ascension and at night a Cam ival of Lights will be the attraction. BTuesday will be ushered in by a gor geous military parade at 11 o'clock. The veteran's drill will take place at 1 o'clock and a balloon ascension at 3 o clock. At 4 o'clock there will be an exhibition drill by Company "E" the crack cavalry troop. At b.su o clock in the evening the Marine Band will give a special con cert at the Academy of Music. On Wednesday the Floral Parade will be the initial feature At 12:30 o'clock Hon. Champ Clark will deliver his ora tion at Vence Park. In the afternoon and evening, there will be concerts by the Marine Band, Red Men's Parade, Fire Works and a balloon ascension. Thursday will be Fraternal Day. In addition to this a tournament and fire man's drill will take place. Something new to New Bern will trans pire next week when summer stock is inaugurated at the New Masonic Thea tre. It is true that the company will not play night in and night out at this theatre until the warm months cease, but it will make several visits to the city during the summer if interest enough is taken in the enterprise, and another stock company, which Mr. S A Schloss and Messrs. Cowan Brothers intend to purchase for their summer season will also visit New Bern. Lach company will be looked after by per sonal representatives of these man hgers and will be strengthened by new vaudeville acts from time to time. The company to start in here next Monday night will be Slater's comedian, sn organization that has a fine reputation throughout the north and middle wrst and a company that is in its eighty third consecutive week.
