PHONE 288. 15 ASSAULTED THfRBB8E0 Johu Hargett, a Janes Oounty Ne gro Found in in Unconscious Condition, While engaged in looking over his machinery a few mornings ago, Wm. Lovineer, who has charge of the Norfolk-Southern coal chute in thia city, found a hat and pair of shoes lying on the ground near the coal pit. Mr. Lov ineer could not understand why these article were lying in such a place, and immediately begun an investigation which resulted in his finding 4 coat and pair of pants. After finding these two last named articles, Mr. Lovineer was satisfied that there had been foul play committed and began to seach for the victim. - . Looking into the coal pit he was hor rified to find the nude body of a negro man who showed sighs of having been roughly treated, and at the time was in an unconscious condition. Assistance was secured and the man was taken to the sani tori urn where" he regained con sciousneso long enough to tell hi i name and that he had been set upon by three negroes who, after robbing him struck him on the bead with some heavy im plement. After telling this he lapsed into a state of unconsciousness, and up to the present time has not revived. The attending physician says that a blood dot has formed on. the- negro's brain and that he has slight chances of recovery. The market steadied-on short covering near the close, and had moderate rally. Lower prices are genearally expected to result from this latest development. While descending a ladder in the tow er of the Federal building yest rday fMr. Clyde Ervin, who is employed by the New Bern Electric Supply Co., and who was assisting in some electrical work in the tower lost his grasp on the ladder and fell about 16 feet.. In falling he struck a fellow workman which broke the fall. A few cuts and bruises on bis body was the result of the acci dent. From the few facts that could be learned it seems that Mr. Church, had returned to the office, at about nine o'clock to complete eome clerical work which he had postponed in order to se cure his supper. The night being warm and sultry he raised one of the windows and pulled his desk near the window in order that the fresh air would strike him. . Shortly after he had begun work a heavy rain began to fall and it was while this shoer was in progress that Mr. Church heard the report of a re volver and felt the sting of a Bullet in his left arm. James Smith Manning was born in Pittsboro, Chatham County, June 1st 1859 and it a son of Hon.. John Manning who for eighteen years was Professor of Law at the University of North Caro lina. His father was a native of-Chowan County and his maternal great grand father was Judge John Hall of Warren County, for many years Judge of the Supreme Court of North Carolina. Judge Manning was educated in the school of Prof. Merritt of Chatham County and at the University of North Carolina where he graduated in 1879. He read law under his father, who was then Professor of Law at the University and was licensed to practice in 1881. He immediately began the practice of law in Durhan- first with his father and then with H. A. Pomhee and by his ability and industry acq lired a large practice, being recognized by the pub lic and his fellow members of the bar as a lawyer of great ability, untiring industry and almost unerring judge merit. He was married December 12th 1888, to Miss Julia Coin, daughter of Dr James F. Cain of Durham County and niece of the late Judge Thomas Refflo of Orange County, and be hat an inter eating family -of four boya and two girls Judge Manning served six years aa chairman of the Durham County Exe cutive Committee and prior to his ap pointment ss Judge had been for many years s member of the State Democrat ic Executive Committee. He waa the Democratic nominee for Judge of the Superior Court in 1896, but wax defeat ed along with the entire Democratic state ticket. Judge Manning has always taken a leading part in the iodaatrUlaod.edu catlonai development of his aeettea. He wae a member of the House of Recresantstlvee in 1907 and served aa Chairmse of the Committee oh Public Service Corporation.
