R., under an errone ous construction of the law from the. Attorney General , has the right to their 500. convicts before the Quaker Bridge road can get any, still we are forced to believe that this section is slighted by the State authorities and therefore tlie , strictures of our cor respondent are in part deserved. Let us review the case. . .. : Last year the ; Journal raised the question liabont'- the convicts and claimed tfiai governor Jarvis and the penitentiary buanl were deliberately disobeying a plain law in sending all the convicts to the Western Carolina Road and none to the Quaker Bridge road. Governor Jarvis replied to this with the opinion of the Attorney General spoken of above. The Jour nal acquiesced in the decision and had no more to say until the 21st of April of this year, when it copied and commented on some articles in the New and Obm-rer which told about the convicts being at work on the Capital 0i course the penitentiary authorities saw that this would not do, for they could not possibly get another opinion from the Attorney General saying that the roads and buildings around Raleigh had a prior claim .over an express act of the General Assembly; and on April 29th Ihe Newiianft Observer had an article ntating that the Board of Directors had taken some action about sending convicts to Quaker Bridge road.
