INTER-STATE COMMERCE. , ; The Senate has passed the inter-, State commerce bill, but it is not the Reagan bill that passed the House. . There is a proviso in the House bill to prevent pooling) freights, and to prevent railroad corporations, ' whose lines extend from one State tp another, from charging more for carryiug goods a short distance than a long one over the same lino.'- This, it strikes us, is the most important feature of the bill. We " can easily understand why a railroad should charge about the same for carrying freights over a part that they would over their whole line, but we see no justice and cannot see upon what grounds, unless it : be , because the people along the. line cannot help them selves, in charging double the price fox carrying freights half the dis tance that they charge for carrying the whole distance. For instance, a friend, who was recently in Flor id, tells us that oranges are shipped from there to New lork for fifty cents per box; but if they are put off at Goldsboro,. right on the Jine of shipment, the charge is one dollar per box. - -: ' Upon the passage of the Senate bill Senator van as made a speech. He favored the J hill as it came from the House. The speech reads like VanCb, and we think it begins to show that Vance will be Vance before (hie seeond term expires, and when this . comes to pass, as Bro. Hale, of the Register, truthfully says, there will be but one such in the Senate. ;1 In reply to remarks of some Senators that it was dangerous to legislate on this subject, and . that Senators were not familiar with railroading he said: ' ; ,!, ' - "Suppose, if you can so imagine, a community of a somewhat Arca dian simplicity where the crime of robbing hen-roosts had come to be something of a nuisance; and sup pose the Legislature, listening to the clamors ot the rural population engaged in that kind of industry, should undertake to . legislate and enaet more stringent laws to pre vent and punish the offense; and about the time they were; ready to proceed, suppose that a. delegation irom persons engaged in the hen roost robbery business should ap pear before the Legislature and should say to them, "Sirs, without meaning to be onensive, we warn you that you are ignorant of this businesBi we notify you . that the jobbery of feathered animals that fly is a highly complicated - and technical business, differing very much from the ordinary vulgar rob bery of animals that walk upon the earth. There is a popular error abroad on this subject and has been from the days of old Moses down. We say that no legislator can have any knowledge of the business except by actual experience. Mr. Alexander said that fully one-third of the public lands of the State was worth one dollar an acre. Messrs. Bower and Todd dis cussed the bill. V " V" : " Mr. Graham said if this bill passes a great wrong" will be done to the people of North Carolina. . Mr, Poole said there seemed to be a misapprehension in regard to the State lands. -. This law does not apply to the swamp and Chero kee lands of the State. So far as these State lands are concerned he thought it was a local matter. Passed second and third readings. , , , , To make a battery of a wife by her husband a misdemeanor Mr.' Poo. said: Blackstone tells us that it is the privilege of the husband to administer to his wife moderate correction.' Such is the law ;in North Carolina. Our Su preme court said in 1866 that while the law does not permit a hnsband to whin his wife. vet the courts will not mtenere wnen ne oniy, unaer- takes to., correct her moderately. In that case the Superior court held that the husband had. a right to whip his wne with a switch no big' ger than , his thumb. Does any law punish a wife for whipping her husband"! Mr. Woodard .commended gal lantry, but said tbe law is well set tied now. In tbe case of the State vs. Oliver, tried in 1870, Oliver un dertook to whip his wife.' The old law is' tot in force in this State. Ko husband has a right to. whip his wife, but the court will not take notice of cases where there is no violence. It now is as if this bill were passed the legal right to indict a man is different from the punishment. Th9 court decides that the legal right to indiqt exists. The court says that a hus band has no right to chastise his wife under any circumstances. But when a man is indicted the punish ment is in the discretion of the court. . ' L " ' - .
