The defence offered ao eridencft, resting tbe case on that already Intro duced for the State. I THE BABY IS OUUBT. The little child who was claimed to have made the perilous passage across the river the dsy of it mother' death, was regularly in attendance during tbe week, in tbe arms of its grandmother. It frequently reminded the vast assem bly of its presence either by its innocent prattle or wail of discontent at (be un anual surroundings to which it was subjected. , His Honor recalled l'earce Kan- and questioned him in refer ence to the identity of the boat taken by Jones on the day of the death. Defence moved that the prosecution be oonilned to one of the two counts la tbe indictment, which was not granted by the court, and exceptions taken by defence. THE AhULMKKT K"U THE DKFKNCK was opened by P. 11. I'elletier, Esq., who, in the course of his remarks, de clared that the whole case rested on circumstantial evidence, and quoted the rules governing such svidence, claiming for the prisoner at the bar the benefit of any reasonable doubt that might be in the minds of the jury . The oiroumstances and evidence were ably reviewed .and an earnest appeal made for the unfortunate prisoner. Geo. H. White, State's attorney, then patted fur the proseeutionHe re eohe4 the langaAfs o fbe genfteman woo bad just addressed the jury, that they had a grave responsibility resting ftpoft tem. He Joined the evidence together in an iogenius manner and en forced it with a high degree of earnest ness." The arKumenl for the defense was resumed by W. W. QlaktEeq. Mr. Clark opened with theaaturanoe to. tbe jury that what he might say in behalf of tbe prisoner would be the last word submitted to them bf aay , one for him, and be felt the responsibility the greater. For himself and tbe jiffy he invoked the direction of Uod Almighty who alone was able to guide tham to a correct con clusion. Mr. piark with much ingen uity raised tbe hypotheses of murder in tb second degree; or willful drowning by the deceased, who after orossiag the river and going up to the untenanted house, had resolved to go no further and returned to the river with tbe intent of going back to her father. la tbe effort of Jones to prevent bert a ai-rrr i souso' qpsucu nuu ua uop upui S TTr! The Legal Profession Defended It is frecyuenlly charged that tlie de fence of any one in court depends upon the money they have. Some go ao far as to allege that money will buy im munity from justice by oommand ins- legal talent. This we all know is un true, but what we do wish to say is that in the oase of Chas. K. Jones at this term of the court no such allegation ill hold good. Jones was poor, unable to employ oeunsel, and Hi Honor Judge Hhipp was careful in assigning counsel and gave as good as tbe baf afforded, Messrs. Simmons, Moore, Clark and Pelletier. Of oourse these gentlemen would not shrink from the task, and in the short time for the preparation of the case, we think put up tbe best defense we have ever heard. Mr. Moore, in selecting the ury, showed tact and skill, while in the examining of witnesses Mr. Him rnoiiH showed more than his usual (tood judgment and skill, i lie arguments by Messrs. Otark and Pelletier were of the highest order. Mr. 1'elleuer did him self credit in the minds of all who lis tened to him, while the effort of Mr. Clark was truly an able one. replete with ingeuiously constructed hypothe sis, enfotoed vrllh all tbe powers of logic. In defending Jones these gen tlemen have made an able defence of their oboeen profession . ' Another What Is It.
