Daniel BUmson for the office of Sheriff; D. N. Kilburn vs. Isaac Patterson for the offioe of county treee urer, and A. G. Oden vs. Dr. H. G. Bates for the offioer of Coroner, and the clerk was ordered to isne a mandamus directing the county commissioners to induct the relators into office according to law. In the oase of Hancock vs Hubbe for the office of Register of Deeds, after argument by counsel. His Honor set aside the verdict of jury, which was in favor of tbe defendant, and tbe relator filed an affidavit for e removal of the cause. The motion for removal was granted and the caae removed to Carteret county. These oasee were of much importance to the people of this county and the final disposition has beea looked for ith much interest. Upon represent tions made as to the conduct of the eleo tion at the James City precinot, tbe Joubnal endorsed lLo aotion of tbe canvassing board, and we still believe that the oonduot of certain partiee at that precinct on tbe day of election was not such as to insure a fair verdiot of tbe people, or to protect the purity of the ballot box. A fair ballot must necessarily preode a fair count; if the Skat has been denied the people, the second cannot be determined with any absolute orrtainty. But tbe General Assembly , after in veatigating tbe matter declared that tbe intimidation of Jamee City was nut of such a charaoter as to justify throwing out the entire box; the Supreme Court has decided that tbe aotion of tbe ean- vaaeing bord was not final, and cow the Superior Court, held here where all the evidence was accessible to both parties, says that it bas not been shown that the intimidation at James City 1 Of suoh a character aa to vitiate tbe entire box. When this was shown by the bearing of the case of Hahn ve. Stimson, we think tbe action of Messrs Simson, Patterson end Dr. Bates who have made most efficient snd excellent offioers, is to be oommended in not contending further. We believe the gentlemen on the coa lition ticket who were declared elected by the canvassing board, honestly be' linved that a fair election would have given them the offices beyond a question of a doubt. We also believe tbey would soorn to hold an offloe if tbey did not think they were justly and legally en. titled to it. and when the General As sembly and tbe courts decide against them and declare that they are not en tilled to these positions they should bow gracefully to tbe law of the land. These cases have caused much bitter feeling in tbe county which should be forgotten.
