Watson & Co., of thi city, on Claim of Delivery. O. H. Quion and P. EL Pelletier, Eeqrs. appeared for the plaintiffs, W.W. Clark, Esq., for the defendants. The plaintiffs alleged that they bad shipped goods to the defendants apon the representation that they were wholesale grocers ia the city of New Berne, and claimed the right to recover the goods upon the ground of the insol yency of the defendant and their intent not to-pay for them when they ordered them. Tbe defendants denied the al legations of the plaintiffs and stated in evidence that4hey intended to pay for the goods when they ordered them. The plaintiffs in support of their alle gations introduced the collector of the National Bank to show that a great many drafts had been presented by hiss to the defendants and only one had been paid. Another witness testified thai one of the defendants hag stated thai he paralysed the bank by paying this draft that when he want in to pay it the collector's under jaw dropped in amassment, the teller came near falling from bis seat and if the cashier had been present there would have been a first class funeral. : . The dsy takes lie name f rum an ancient custom of shrink ling ashes on the head in token of re pentance and humility, but its chief importance is that it is the beginning of the penetentiaJ season of (he church, lasting for forty days, exclusive of Sun days, commonly called Lent The whole year is a season of penitence as that ia an essential pari of true worship of Almighty Ood and begins with the exhortation that He pardons iboee wbo oonfess Iheir sins with an humble, low ly, penitent and obedient heart :o ihe end thai forgiveness of the same may be obtained through His infinite good ness and mercy, but this is an especial season set apart for that purpose and in which the people can more frequently assembly and meet together lo render thanks forhe K'eal benefits received at His hands, lo set forth Hiswofl worthy praise, lo hear Ills m st holy ord . and to ask those things Ij i h a i e requisite and necessary as well f r the body as the soul During Lent (be i hutch calls uimn her children lo draw etecilly near to her. lo refra.n from or Idly am use menls. practice, such abtlenance as will aid in the performance of cilia ordinary at is of devotion and dis cipline. Then let each and every one w ho would receive, ihe full benelits of the lenten season begin tomorrow in earnest determination, to attend tbe services and listen to tbeir duty with an honest heart in order to practico it. Tom. Street Cleaning and Side Walks. Editor Joctinal The time ia now rapidly drawing near when our city will be visited by a large concourse of people to attend the Oyster Fair. Allow me to suggest that a special meeting of tbe city council be called, for the pur pose of making arrangements to have our sidewalks put in something like decent order. It is true that they are now in a better condition tban they were before Councilman William took charge of them, but tbey are not as yet model sidewalks. I also suggest that tbe city authorities order tbe bricks on the sidewalk between Meadows 'corner and South Front street to be taken up immediately so a to make it less dan gerous to pedestrians. I wish to make another suggestion; it is, that the city council employ sweeper to remove the large quantity of brickbats, straw, paper, glass, rotten wood and unbroken oyster (hells now on Craven street be tween Pollock street and Trent river ; as for South Front street, from Gate' corner to Middle street, thence down Middle street to the market, I hare nothing to say, being convinced that a large part of the tax collected in tbe city would barely suffice to put that portion of the city in very nice order before tbe week of the Fair. All I wish, and all eyery other taxpayer wishes is that our worthy Marshal, Mr. Harget, may be given a oarfe blanche to proceed immediately in the matter of cleaning the streets, and it will be attended to. I am sure that he is as anxious that our oity should present to strangers a neat and clean appearance during Fair week as any other citisen of New Berne. I am of the opinion, Mr. Editor, that if that good man Job had been com pelled to walk down such a place a the east side of Middle street from Mead ows' corner with rheumatio ankles or with corns on his toes, he would hare had stilt greater trials and larger de mands upon his patience. In conclusion -j I say that the untidy condition of our streets refieof bo credit oa our oity oounoiC and the brick sidewalks on th east side of Middle street, between Pol look and South Front, are a disgrace to the city -and the city council should order the bricks taken vp. a Tt -r- ir"a.numerous household is the safe ty of tbe fiepuhlio," it might as well be proclaimed at once that the remedy apon which each household should be reared Is Dr. Bull's Baby Syrup.
