The church was packed yesterday at the 11 o'clock servioe. The subject was "Looking Unto Jesus, "and was hand led in the preacher's usual simplicity of style, illustrating his scriptural quota tions with force and striking effect. At the conclusion of his sermon several went forward and confessed Christ. At night long before the hour of ser vices the church was densely packed. Rev. Dr. Vass conducted the prelimi nary services Rev. Mr. Pearson being informed that the church wu nlld and tliat thecugrogttioii would take it as a favor if he would come on and be gin the services, he arrived some min utes aht ad of time and began bis last union at these meetings. It was strictly what we would term a gospel sermon: au effjrt to convert sinners to Christ. From the News A Obterver we get the following digest of the Supreme Court decisions: There was assessed against some lots owned by the plaintiff in Halifax coun ty taxes to the amount of $23.40, whioh tbe sheriff was proceeding to collect, when the plaintiff asked for an injunc tion on the ground that the lota were exempt from taxation under the charter of the company, as held1 by tbe Supreme Court of the United Brates in 13 Wal lace, p. 284. He'd, That the act of Assembly, sec. 84, chap. 137, acts of 1887, forbidding any oourt to issue an injunction to re strain the collection of a tax except where the same is levied for an illegal or unauthorized purpose, and requiring the payment of the tax with liberty to sue for tbe same, is constitutions), and such injunctions can no lons-er be issued. This is tbe act under which tbe com missioners of Carteret county resisted an injunction against the collection of taxes in exoess of the constitutional limit; claiming that such levy was for a legal and authorized purpose. The case was ably argued by Hon. C. R. Thomas for the tax payers and Clement Manly, Esq., for the commissioners before Judge Phillips at Kinston last fall. He held that the act was con stitutional' and it appears from the oase cited above that the Supreme Court j has sustained him. N This decision does away with the in junctive remedy against excessive taxa tion, and we might say virtually abol ishes all restraint to such excess unless leyied for an niauthorlxed on an illegal purpose. It the tax exoeeds the con stitutional limit the taxpayer is bound to pay it and then sne the county for its recovery. It will be apparent at once that the remedy though adequate is utterly impracticable. The General Assembly was doubtless prompted to bhange tbe remedy for re lief against excessive taxation on ac count of the numerous injunctions in oases where tbe constitutional limit was not .sufficient for a county to pay cur rent expenses,' and of neoessity they were obliged to go beyond or ran on credit which is ruinous.'' Seymour was engaged at chambers yesterday in bearing the case of Kountroe & Co. against Josiah Lxurn, assignee of W. 11. Dail & Hro. The plaintiffs alleged fraud iu the assignment and sued out an atlaehmeut in the circuit court of ths United iS Laics on certain propeity of the defendant Tbe hearing yesterday was upon the motion by defendants to vacate the at tachmenl upon the ground that tin re w as no evideucs of fraud. The case was nrgued for ihu pUiiitiils by Geo. Itouulreu, Esq., of KiutloU, 1. A Woodard, Esq., of Wilson, and .S K Mordecai, Eq , of Raleigh. The de fendants were represented by Clark ft Ciuik of this city. Decision reserve J Heavy Shipment. The N. C LiSe dispatched the steamer (Jeo. H. Stout yesterday at 2 o'clock direct to Baltimore with the largtat cargo, out of New Heme this season, consisting of US, 100 feet lumber, 115,100 shingles, 155 barrels tar, 100 barrels pitch, Wl barrels spirits turpentine, K0 empty barrels, Oil bales cotton, 00 pack ages merchandise, 00,000 shingles. Total 333 tons. This line now haying the steamers Geo. 11. Stout, Experiment and De fiance all in good order will resume their semi-weekly trips to Baltimore, this being the only direct line to Iiulu more, without change of bulk, and shippers will avoid rebandling by ship ping by this route. Cash, of South Caroliua, is not dead, as reported . Ho is very feeble, but no worse. The latest from the German Crown Prince is that he is belter, then worse, then vice versa. An extensive fire occurred at Sals- manoa, IS. l ., early Wednesday morn ing, causing a loss of 975,000. Professor John M. Langston, colored, of Petersburg, Va., addressed the Hote committee on Eduoation Wednesday in advocacy of the Blair educational bill. The will of the late W. W. Corcoran was probated Wednesday. Several publio bequests are made, and some to personal friends and servants, and the remainder of the estate is left in trust for hi three grandchildren. The Elizabeth City Economist says: The Baptist congregation of .this town are making efforts to build a new church to accommodate their increasing attendance. Reports of fish and fish ing of the netters on the Sounds are not encouraging. Tbe eatch at this time of tbe net is not equal to tbe catch at this time last year. The strikers on the Burlington system do not seem to be making much pro gress. All of the mail trains are run ning without interruption and the Chi cago suburban service is in full opera tion. Large number of Knights of Labor engineers and firemen are going forward to take the places of the Brotherhood, but express themselves ss willing to return when the latter are called off from the Reading and Brook lyn eleyated roads. In the Senate Wednesday the bill pro viding; for the compulsory education of Indian children was passed, after which the dependent pension bill was taken up. Ag gregate for month, 81,570 93. They Kept his .Whiskey Moving. Montreal, Feb. 28. John Tomley, of Dundee township, Hunogton county, was arrested here today and is now in jail. The house wher. ho lives is just on the border line. Five years, ago Tomley was in the liquor business and came to Montreal and gave an ei tensive order for whiskey to W. F. Lewis & Co., giving a note in payment. When th note fell due he refused to pay it and a writ of seizure was issued against hi stock of liquor. Then the fun be gan. He had transferred his spirits to the end of his establissment, which is situated in New York State, and the Canadian officers were powerless to do anything. Then the American authori ties prosecuted him for bringing stolen good into the country, and the goodB were moved back to tbe Canadian side.
