B. 726, in relation to elec tions, was taken up on its third reading, a motion to postpone until Wednesday next pending. Mr, Thomas favoring the postponement. Mr. Little saw no necessity for any postponement on this question. Be called for the previous question which was sustained. Tbe motion to postpone did not prevail. The question being on the bill on its third reading, ir. Lust in oppo sition to the bill led on with the argument tnat it established an intellectual qualification for the enjoyment of suffrage, lie feared this would lead to, if not force, a conflict of races. This was a direct enort to uisiranchise tbe neerro race, as the majority of them could neither read nor write. Mr. Payne, in charge oi the bill addressed himself first to a direct threat thrown out yesterday by the Senator lrom Davidson (Mr Thomas) that a Republican Con gress and a Republican President soon to take hold of national af- lairs wonld interfere, with all the power of the government to regala'e the affairs of elections in this State if this bill was to become a law. It such a threat was to become a fact then i behooved the Democratic party to prepare for it. In reply to the Senator from Buncombe (Mr. Lusk upon his argument as to a race conflict he said the only attempt in that line which had ever been made originated with and had been promulgated by the republican par ty oi JNortn uarouna. I he Kirk war was without a parallel in the history of any State,upheld and inaugurated by a Republican Governor who but yesterday attempted to have the disabilities removed from him which had been put npon by the Senate of his State sitting as a coart of impeaobment for violations of the Constitution. lie referred, npon the line of oppression spoken of by Mr. Lusk, that he had in his mind a time when the Senator from Bancffmbe was U. S. District At torney aad had drawn bills of in dictment against Judge Bennett and other citizens of North Carolina which were oppressive indeed and should bring the blush of shame to his face if he was capable of such a thiug. lie knew whereof he spoke, for as an attorney he defended those indicted citizens. It bad been in timitated that this bill was uncon stitutional. It was not so, and in no particular was it in conflict with tbe State or National Constitution. In regard to the provisions of the bill it did not inflict a hardship upon any honest voter. It was charged that this bill was a copy of the South Carolina election law. Why. if it was, it would have scared the Republicans to death. That was a law which was measured by inches, feet and yards, though it had never been declared uncon stitutional. The New Hampshire law restricted the qualifications of a voter to property and it could not be found in conflict with the Con stitution of the United States. Mr. Thomas ofDaridson, said be would name this billTb South Carolina Election Law. He sent forward ten amendments to strike out tbe ten sections of the bill. Mr. Stubbs, spoke in support of the bill not because of the past but for the present and the future and the best interests and prosperity of the State. The bill carrys on its .facejthe true (essence of a free and fair ballot, it was the only law which could secure such a nse of the election franchise. The colored man was a political factor and in telligence mast very soon solve the problem. He did not believe the last will and testament of onr fore fathers could ever by intelligence be construed to devise this land and country to the control of the colored race. He had as great an admiration for the old servant of ante-bellum days, as any one.
