Before tbe Sanitary Committee makes it next report to the 'city oouneil we invite the gentlemen composing it to nspect tbe vacant lot near the llughes wharf below the market dock, and tbe wharf also, and to examine the south ide of South Front street just west of the railroad Peruana there are many other plaoe in the city that ought to be xamtned, but a visit to these will probably have something to do with tbe make-up of Ihe next report. New Berne is on a boom now ; let no bids for yel low fever be tolerated. Pamlico vs. Cravsn. Tbe commissionarsof Pamlico count; or some of i s citisens have instituted proceedings to stop the collection of taxes to pay the indebtedness of that county to Craven, and have a referee appointed to aaoertain th amount of said indebtedness. The case having been settled by the courts and the com missioners ef the two counties hsving met a year or two ago in this city nd thoroughly examined the payment and credit to tbe satisfaction of all, it would eem new to' be an unnecessary waste of time and money to carry the matter into the court again. But a we do not understand the ground upon which tbe proceedings have been started we will wa.it for the hearing. W will say this. however, if Pamlico can repudiate her obligations to Craven and be sustained by tbe courts then it will be time for the tax payers of Craven to stare the kick ing process. Important Suit. An interesting question waa decided by our Supreme Court on Monday last between the Episcopal Diocsse of East Carolina ana the Diocese of North Caro lina. In 1879 Miss Mary Ruffin Smith of Orange county in this State by will devised a very valuable estate to the trustee of the Diocese of North Caro lina for the use of the Protestant Epis copal church. In 1888 the Dlooese wa divided and in 1889 Mis Smith died. A friendly suit was instituted by the Die cese of East Carolina against that of North Carolina for the purpose of hav log the will construed. The contention oa the part of the Eastern Diocese being that it wa entitled to one-half of th estate devised because at the time the will was made it was a part of the Dio cese of North Carolina, and that so far as the object of the devisee was con cerned the will must be construed as of its date. Whereas, the ether diocese contended that it alone met the descrip tion of the benefieiary in the will at the time of tbe death of the testatrix, and was therefore entitled to the whole of the devise. The Supreme Court decided that tbe claim of the Eastern Diocese was cor rect, and gave In judgment; in its favor for one-half of the estate. The Eastern Diocese was represented by Bon. George Davis of Wilmington and M s jor John Hughes. of this city and that of North Carolina by Hons. John Manning of Chapel Hidl end Rich ard H Battle of Baleigh. ' ' A valaess Bu'l Clear Vlslo.
