The resolutions passed by theoity council of New Berne on 1st day of March, 1893. (which have been pub lished in the Joubnal) were submitted to the Board by his Honor, Mayor Hanlr, and on motion, it wae Ordered That, Whereas the city oounoii of the city of New Berne, through the Mayor, the Honorable Matt Manly, has this day submitted to the Board of Commissioners ot Craven oounty a resolution passed at its session held on the tfth day or February, 1SUU, declaring that the E. O. L. & R. W. Co., haa thus far failed to comply with the agreement and understanding under which a subscription of 830,000 in bonds, of said oity was voted to aid in the construction of a railway from tse oity ot Wilmington to the city of New Berne, ana Whereas, On the 5th day November 1SS9, an order was made by this Board to submit to the qualified voters of the oity of New Berne, the question of sub scribing the amount of $50,000 in bonds of said oity to aid in the construction of a railroad from the city of Wilmington to the city of New Berne, and Whereas, It was a part of the under standing and consideration upon which the said proposition was submitted to the people, that if the said subscription in bonds was voted, the said road would be oonstruoted and completed within a reasonable time thereafter, and Whereas, The proposition to subscribe said bonds was duly ratified at the eleotion held for that purpose, on Thursday, the 9th day of January, 1890. and whereas the city of New Berne has at all times since said election been ready and willing to issue and to de liver bonda to said East Carolina Land and Railway Company upon oomplianoe on its part with the terms and under standing under whioh said proposition wae submitted and ratified aa aforesaid. and whereae the said East Carolina Land and Railway Construction Com pany haa failed to keep and perform its part ot the agreement and understand ing under which the said proposition waa submitted and ratified as afore said, now therefore it is Ordered, By the Board of Commis sioners of Craven oounty, representing the people of the oity of New Berne, under the aot of the General Assembly of North Carolina, ratified the 9th day of January, 1899, that the said company is hereby notified that unlets it shall comply with the understanding and agreement under which said proposi tion wae submitted to and ratified by the people of the city of New Berne as aforesaid within a reasonable time for the adoption of this order, to-wit, on or berore the 1st day of July, 1BU2, which is deemed a reasonable time for such oomplianoe, the said East Carolina Land and ttailway Company will be considered to have failed in the per formance of its part of the said under standing and agreement, and to have forfeited all claims to-bare eaid bonds Issued to it; and suoh steps as may be necessary to have the issuing of said bonde perpetually restrained will be taken.
