''JR., THURSDAY, APRIL 2, 1925 THE CAROLINA MOUNTAINEER A BILL TO BE ENTITLED AN ACT ESTABLISHING A GAME COM MISSION FOR HAYWOOD COUNTY. The General Assembly of North C'ar lina do Enact: Section 1. That for the purpose of carrying out the provisions of this act a Game Commission isi hereby established in Haywood County, which commission shall be composed of time meiir.'ber.s, and I). Clark is here jy named one of said commissioner.-;, who shall hold office for a period of two years, and G. C. Plott is hereby named one of said commissioners, who shall "hold his office for a period of four years, and Dr. T. A. Harg-rove is hereby named as one of said com missioners, who shall hold his office fo a period of six years, and each of said commissioners shall hold their respective office until their successors shall have been duly named and qualified. Sec. 2. That on the expiration of the terms of office of said commis sioners, said vacancies shall be filled by the remaining two commissioners, and for the period of six years. Sec. 3. That it shall be the duty of said gum commission, on the first day of April, one thousand nine hun dred twenty-five, and annually there of ter, to meet and organize by elect ing a chairman of said commi&sion, and a treasurer, and to appoint a ch'sr game warden for Haywood Co'' lty whose duty it shalll be to diligently enforce the game laws of Haywood County as herein set forth, and all other game laws applicable to said county, either general or spe cial; and it shall further be the duty of the chief game warden to appoint as many deputy game wardens throughout (the courtty as he may . i. . 1 1 i i . deem necessary, tin it mum u the duty of said ciefh game warden, and his deputies, to co-operate with thr. State Fiih 'Commission i(n all matters pertaining to the propaga tion of iftsh and the protection of the streams of said county when request ed by the State Fish Commission. (Sec. 4. Every game warden or dep uty game warden so appointed shall, before entering upon the du. ties of his office, lake nd subscribe before the Clerk of the Superior Court of Haywood County, an oath to perform! the duties of his office, to gether with those subscribed for po lice officers, and to execute bond in such sum as the game commission may prescribe, for the faithful per-' foiniance of his duties. Said oath and bond shall be recorded by the Clerk of Haywood County, and who shuil not charge more than fifty ."ems for administering and recording sai.l oath. It shall be the duty of all war dens and deputy wardens to arie.'-t all violators of this act, and they are hereby given all the powers and au thority as now vested in the sr.irilT and deputy sheriffs of Haywood Coun ty, in so far as the enforcement of thi.s act is concerned. iSec. 5. That any person desiring tj hunt in Haywood County, who is not a resident of said county, but is a resident of the State, shall first ob tain a license from the chief game warden of said county, or his duly named and appointed deputies, which license shall be on a regular printed form and shall be good for the hunt ing season in which issued. All such license shall be issued in duplicate and a copy thereof filed with the Regiter of Deeds, and the fee for such license shall be the sum of ten dollars That any person desiring to hunt in Haywood County, who is not a resident of said county, and who is not a resident of said state of Noiih Carolina, shall first ootain a license from the chief game war den or his deputies and which license shall be on a regular printed foim, and shall be good for the hunt ing season in which issued, and shall be issued in duplicate and a copy filed with the Register of Deeds, and the fee for such license on non-resident hunters shall be the sum of twenty-five dollars; Provided, that the license tax herein prescribed to be paid by non-residents of the county and non-residents of the state ."hall not be paid by any party who is a bona fide member of sann chili or organization of Haywood Ci jnty en gaged in protecting game and propa gating the same; and provideJ further, that said member pay-"' dues to said club or organization in an amount equal to the license tax hereinbefore provided to be paid. All license fees collected and received by the chief game warden or his deputies, undov the terms of thus section shall be im mediately paid over to the treasurer of the game commission, to be used the game commission as hereinafter provided: Provided further, that all persons who desire to hunt, off of their own premises, shall pay a tax jf one dollar and twenty-five cents, . xcept minors under the age of fif teen years who shall hunt on their own or their parent's or guardian's lands. All license for hunting issued te non-residents, and residents shall !e non-transferable and shall he car ried on the person when hunting and shall be produced for inspection op demand of the chief game warden or his deputies. Sec. ti. That all nftmcys receivid by the fame commission by reason ef license fees, or otherwi.se, as herein provided, shall he held by the treas urer of said commission and paid out under the orders and direction of said game commission in paying the ch ef GAIJ.EY FIVE game warden and his deputies, and other expenses of said commission. Any surplus in the hands of sa:d commission shall be used and expend ed by said commission for the pro tection of wild game, for the enforce, ment of all game laws, and for such matters and things as may b? nec essary in the discretion of said com mission. Sec. 7. That it shall be unlawful for any person or persons to hunt or trap upon the lands of another with out first obtaining the written per mission of the owner of such lands, his authorized representative. Sec. 8. That the open season for hunting in Haywood County shall be as follows: (a) For deer, from November first to December thirty-first, inclusive, and no person shall kill more than two deer, both of which shall be bucks, in any one season; . (b) For quail, partridge, pheasant, wild turkey, woodcock and doves, fiornT November fifteenth to January fifteenth, both dates inclusive, and no person shall kill more than fifteen ouail or partridges or doves in any one day. or more than one hundred in any one season; nor more than four pheasants or woodcock in any one season; nor more than two wild tuikeys in any one season; Provid'd, that no wild turkey shall b killed or taken before November fifteenth, one thousand nine hundred and twenty-six: (c) For squirrels, from September fifteenth to December thirty-first, in clusive, and no person shall kill more than five squirrels in any o'ie day, or more than forty in any one season; (d) For bear, from October fust to January first, inclusive; (c) For opo.ssum and raccoon, from Spring's S Time When the warm days of spring arrive, the people of this community just naturally want to buy things to wear. That it shall be unlawful for vny person to set any bear traps, steel trap, dead-fall, snare, or any device whatsoever for catching wild animals or birds; Provided, that lab bit Kuins or boxes shall not lie so considered: And provided farther, that any person may set a trap upon hi.s own premises for the purpose of catching any wild animal making depredations upon his fowls -; other domestic animals. Sec. 10. That any person viol.uintf any of the preceding sections cf this act shall be (ruilty of a .misdemeanor and punished in the discret'un of the! court. See. 11. That it shall bo unlawful, for any person to use, or to have in his possession while hunting, a maxim silencer, or to use or have on hi.: (run wihile hunting, or in hi possession while hunting, any other device or n'Cthod for killing or smothering the report of any fire arm used in hunt-, injr. That any person violating thi. terms of this section iMiiil be guilty of a misdemeanor and shall be punish ed in the discretion of the court See, 12. That it shall be unlawful for any person, firm ji corporation to sell, offer fr sa'e or ftave 'n his possession for the puriiis-' of sale, either directly or indirect';.', ai.y deer, or part thereof, any 'j"!', or part thereof, any partridge o- quail, pheas ant, wild turkey, or dow, and it shall further be unlawful for any such person or persons, ftm o.- corporation tn .sh.p, convey, tran.rpni-., or cause to be shipped, transp, itcd or con. veved in -nv .nonner ru '.?? ' 'i' f Haywood County any such game; Provided, that any person who is a bona fide member of any hunting cor poration or organization )f Haywond County who lives out of the county, and who shall have paid his dues for the season to such club or organiza tion in an amount equaling the li cense tax hereinbefore provided for, shall have the right to ship, tran.s use out of the county and out of '.he State, such game as he may individ ually kill; any person violating the terms of thi.s section shall be guilty of a misdemeanor and punished in the discretion of the court. Sec. 13. That this act shall apply to Haywood County only. 'Sec. 14. That all laws and clauses of law in conflict with this act are hereby repealed. ! .Sec. 15. That this act shall be in full force and effect from and after its ratification.
