SPECIAL TERM SUPERIOR COURT Now In Session Land Cases Move Slowly Two Days To Try McClain-Carpenter Case And Mistrial Result. Special term of court for trial or civil cases only, opened Jan uary 8th, with small attendance. Judcre R . B Feebles who occu pies, the bench, is unlike the judges usually seeiv here, being stern with the attorneys and, as one citizen remarked when praising -Judge Peebles for his work: "He won't' let. the law yers run over himself or bqll-doze witnesses. That's why I like him." - Land cases are slow movers, consequently but few cases have been tried. Case No. 3 on the court calendar (the calendar appears elsewhere in this issue) took two days of the court's time and then resulted in a mistrial. Other cases disposed of are as follows: No. 6 Rollins to recover $93.75. No. 7 Arledge to recov er, $20. No. 3 , mistrial. No. ir, 'dismisseU Nos. 12 and 13, Ponder vs Insurance Co. , both cases were consolidated so as to be-tried as one This case was left orJeii until Wednesday 17th, on account of absence of one of the plaintiff's attorneys. A RUTHERF0R0T0N INSTITUTION FAILS The Cause Of Failure Due To Unpaid Notes Aid Loans Past Due Officials Claim Deoo&iors Will Be Paid Dollar For Dollar Assets $25.000 Chartered In 1891 With $10,000 Capital. F. H. Haywood, Jr., of Raleigh State bank examiner, arrived on the Southern's train Saturday raorning, and, after making an examination of the Bank o f Butherfprdton, at noon closed it and posted the following notice on- the door: 4 'Bank closed b y order of the North Carolina Cor poration Commission, F . H. Haywood, Jr., State Bank Examiner,- January 6th, 1906." A ' Sun reporter at once called on Haywood, but nothing further could be obtained from him, except that he was in charge. A receiver will be asked for, and will of course be appointed. F. Morrow, the president, was seen and he stated that the bank was closed on account of notes and loans that were past due and had not been paid, but which he considered perfectly .'good paper, r He also said that the assets were far in excess of flie liabilities, and that all the depositors would be paid dollar fnr dollar and that the stockhold ers would lose very little, if Anvthinar. The assets, according to the nresident are $8,000 in cash; $14,000, in notes and bonds; and furniture, fixtures and the bank ing house, valued at 3,000, mak ing a total of 25,000. The cash and the Rutherford county bonds SL2G0 which are now due ' and for which money is ready for navment. it is claimed, will nav the total indebtedness of the ' bank and leave $7,000 worth of UOteS tO De.CUHWM5U, WHICH Will to the stockholders. The capital stock of the insti : tution was 10,000. The bank was organized in 1891. - RECEIVER APPOINTED. Since the above has been put into type, The Sun learns that John C. Mills has been appointed 'receiver for the Bank of Ruther fordtoh. These are the facts so far as we are aoie to get them at this time. Best wishes for The News and its readers during the New Year. We understand that Mrs. J. D. Gibson's two sisters visited her during Christmas week. We understand that Weldon Turner has purchased a new saw mill and hopes to have it convert- ng "saw logs" into lumber soon. We enjoy reading the "Home Circle' and are looking forward to the New Year pieces. Each one proves both interesting and beneficial. Mrs. Dr. 'H. H. Edwards, is visiting parents and relatives in Pennsylvania. We feel sure she has spent a very pleasant Christmas. Your correspondent has been engaged in teaching during the past six weeks, but had the pleasure of spending Christmas holidays with relatives at Mill Spring. Waldrop-Bishop. Mr. Lindsey Waldrop and Miss Eva Bishop were happily united in the bonds of holy matrimony Dec. 13. Rev. J. D. Gibson, officiating. Best wishes to the pair. Blackwell-Gosnold . Robert Blackwell and Miss Celia Gosnold were married Christmas day. Wm. Wilson pronounced them man , and wife. Happiness and success to them. . Mr. James Carpenter,, is visit ing relatives at Mill Spring,1 We understand he anticipates spend ing the winter in North Carolina. We wish him a very pleasant visit. All who are acquainted with him are glad to have him in our midst. Misses Emma Andrews and Ollie Walker visited the home of Mrs. E. L. Hague Dec. 26th, Willie Walker accompanying the ladies. The day was very pleas antly spent. The only objection was, it seemed too short, but we hope to be together again some day by and by. Emma Andrews is teaching at Beulah this year. We are so glad that our beloved pastor was sent back to us an other year. Fred Jackson, who is employed in Tryon Supply Co., visited his parents here last week. D. T. McClain and children, of Rutherfordton, visited their old home at Bright last week. John Harley and wife, of In- man, b. u., visited friends in our village Christmas week. V Mrs. J. R. Foster, of Mill Spring, spent Tuesday night of last week with her aunt Mrs. R. L. Hamilton. B. R. Ledbetter, who is con ducting our school, visited rela tives in Buncomb county Christ mas week. Richard Ledbetter and daugh ter, of Rutherford county, visited Ancuua anu J relatives in our section last week. t ..-.. Rev. John Walker filled his appointment at Silver Creek on third Sunday. He. and his wife remained a few days with her parents. W. M. Justice and wife gave a turkey dinner to their children on Christmas day. After dinner the guests were entertained with music by Mr. Foster and daugh ter Rosa, and Annie Foster. Mrs. R. L. Hamilton and B. U. Ledbetter went out visiting Saturday and while they were gone C. E. Justice and wife con cluded to kill a pig and chicken and Mrs. Hamilton and B. R. Ledbetter returned just in time for the feast. The nineth session of the Polk county Baptist Sunday chool Association convened with the church at Mt. View Dec. , 30th and 31st, 1905. In the absence of Rev. John Arledge Rev. A. T. Cribbs was elected chairman and M .' E . Searcy secretary. ; The subjects were discussed by a number of the brethren. The subj ect of Brotherly Love was very feelingly discussed and, during the entire session one could s e e a n abun -ence K o f brotherly love exhibited. On Sunday at 10 a. m. . the subject of Faith was ably d i s -cussed by A. T. Jones. At 11 a. m. Rev. John Arledge preached the sermon. The mass meeting in the evening was interesting The singing under the auspices of W. M. Barnett and a" number of other good, singers was com plete. The entire session . was a grand success. '(the increased interest and attendence at the meeting indi cated that the Polk County Sun day School Association is doing a good work.
